这话也没有说错。我这个人为朋友两肋插刀,老是给对方告。有一次,我的客户欠商业
房东租金,因为他的生意不好,房租一个月就3万美金。我觉得他人不错,就拼命保他
。结果损失了35 万房租的犹太人房东就请律师把我告了。说我滥用司法程序。
又有一次,我的客户在以前的律师那里败得一败涂地,后找到我,就开始咸鱼翻身,节
节胜利。对方一看,还是关键在律师。就也来告我。跟我打过官司的人都恨我又怕我。
我的个性就是,喜欢帮你就帮你,不喜欢,给钱也不管你。因为我不缺钱,也不贪财。

这花样和美国卖琉球给日本一样,就是quit claim deed
的意思。中国当然不会象日本那么傻,白白上当。中国
需要有很好的谈判专家。
中国应当要Grant Deed。美国拿钱后,就应当承担执行
开罗宣言和波斯坦协定的义务。当中国对台湾的主权受到挑战时,
美国有义务使用一切手段,包括军事手段,来捍卫开罗宣言
和波斯坦协定中台湾部分。

btw, trust fund还是要以慈善最为名义上的目的和资金消费口, 你自己看一下trust
vs. foundation的区别。 所以一般说信托的时候, 它都有相关联的慈善机构作为销账
的工具。

I haven't seen any proof that the house was purchased with cash. The deed
shown online was a quitclaim deed, allowing Liu Juhua to have all of the
right to the house. But it doesn't contain anything about date and price
and payment method of the original purchase.

你这个给的是因欠MORTAGAGE引起的普通REAL ESTATE FORECLOSURES 走的程序和财权先
后和分配。我说的根本不是这个,我说的是房子因为欠了地税(而不是MORTGAGE),被
县政府直接拍卖的DEED SALE.
FORECLOSURE 的往往是因为欠银行的钱,需要先DEFAULT ,然后银行律师介入,上法庭
,然后拍卖。银行的律师会给欠款人足够的时间和NOTICE,至少也要用挂号信寄给欠款
人告诉他不还钱拍卖即将发生。DEED SALE这个根本不用上法庭,也没有什么COURT
COSTS.我在堪萨斯拍卖的一栋房子,最后那家人都不知道自己的房子被政府拍卖了。
再强调一遍,不论拍卖的房钱最后给不给房主,着都不是争论的重点。人家拥有这个房
子,没有交地税应该罚款或者可以去法庭告欠费的人,可以从工资里面扣,或者给房子
上加一个LIEN,而不应该未经允许直接拍卖人家的房产,你有权直接拍卖人家的房产,
等于剥夺了人家的所有权,或者说收回了所有权,既然如此, 那么在拍卖的时候,谁
拥有这个房子的产权,显然已经不是物主了,那么是COUNTY吗?也不是,否则为什么竞

真相:美国地面和地下产权在绝大多数情况下是分开的。买房只买地面,地下部分几乎
不是讨论对象也不会卖给房主。地面部分可算永久,前提是记得交房产税。挖坑一般是

国人对美国的采矿权有极大的兴趣,流行的说法是有了房子,地面上下800米都是屋主

我说:加名字贷款没有影响,而且我会权衡利弊,利是100块,弊是牺牲自己的利益承
担风险,当然选择不签。我没有不为大家考虑,只是在法律允许的范围内,保障我的利
益。

蒂。
不可否认,老公比我优秀太多,公公婆婆一直以来都希望他找个优秀的女生。

的期间,公婆还在继续介绍各种朋友的孩子,不是家里有钱的,就是学历高的,漂亮的。

I know some good deeds Trump did. This Liberty University校长 just mentioned
a few more. Trump donated money to local pizza shop so that they have
money to buy cheese and other material to stay afloat. Trump have his hotels
order products from three Maytag producers in Iowa so that they don't have
to close. He donated his own money to help people out here an there.
If you judge a person by the deeds he made, Trump is a good person.

补充一下:我家当初也是我一个人贷款,LD不工作。律师说,贷款只是我自己的名字,
但deed上可以是只有你自己的名字,也可以是夫妇两人的。这是我家的情况。而事实上
,另一朋友也是丈夫一方贷款,deed也没有加老婆的名字。凭我律师的说法是丈夫不让
加的。后来他老婆听了我家的故事后,和他大吵一架。

1. 是有点帮助的,但主要还是看信用积分,车贷只是信用历史,而且车贷额会影响房
贷总额。
2. 为什么要两个人放贷,我问过中介和lender,他们都说弊大于利,因为一旦断供,
将影响两个人的信用记录,除非一个人的贷款不够。很多人是一个人贷款买自主房,然
后用另外一个人的贷款买投资房。
3. 如果担心房契(deed)的问题,可以把两个人名字都加在上面,还可以一个人贷款。
但是不贷款的人在房子因断供而被银行收回的过程中,没有发言权。如果是正常的房屋
买卖,必须要deed上所有名字的人签字。
希望以上信息能有所帮助。

讲到设计,我们还是先回头谈一谈加建和翻建。我在网站上讲过“如果你给我十万我能
帮你做出二十万的效果;如果你不幸给我三十万,对不住,还是二十万的效果”。因为
三十万一定是推倒重建。想你四五十万买的小烂房,不用告诉我它有多小多恶心,但它
至少也值十万到十五万。大家都喜欢二层楼的气势雄伟的大房子却没留心市场上加建出
来的重重叠叠,趴在地上的老房子要价也不低(如果位置好就更了得)。如果你买杯咖
啡也要想半天是去麦当劳还是starbucks, 那你推平这十几万之前更应该想清楚。
前文提到经高人(general contractor)指点我在mortgage的deed上面画的设计。(这
种做法在有的town可以,尤其是你的frontline 很长)做个survey下来三个星期就没了
不说还要花八百到一千二。我心疼这八百银子就拿着deed上阵了。后来survey查出了
easement和wetland我想抽身而退都来不及。
我的general contractor是在《侨报》上找的,因为我初来乍到无人认识。第一个谈的
是天津人,大雪天领着我去看他刚完工的工程。deck很大,看着让人高兴。(因为

他家的车title也是先生名下,有必要先过户/加名字吗? 怎么办? 去DMV,还是网上
填form寄去就行了? 现在让重病朋友亲自去肯定不可能了。
其他的关于他家银行账户、信用卡、mortgage什么的,各位有什么建议吗?

general/full warranty deed 是上任房主保证房子在自己拥有期间【及之前】,产权

It is very complicated to explain.....but it basically means that the
deed, which denotes ownership or who owns the property, has not been
recorded at the Franklin County Auditors office. Once a house changes
hands, the transaction has to be legally recorded at the Franklin Cnty
Auditors department. Then it becomes part of the legal ownership of the
property.
This property, the deed has not been recorded at the auditors dept. yet.

房子过户5个月一直没收到房产证,今天突然收到一封从National Deed Service, INC.
来的信,说是要寄给他们$79.5才能收到Deed,我一直以为房产证是免费从county拿到
的,难道不是这样的吗?

short sale 的房子是麻烦点,但并不是说就不能碰, 关键是要多费点心,特别是过程中
所有的文件签字前要看清楚,不明白的地方要问,EMAIL 问,可以保留证据,所有的东西别
想当然, 另外这几个要搞清楚,
1. deed 和贷款情况查清楚, 看看到底是怎么回事,
2. lien, 你看deed 和贷款的时候也应该看到是否有lien, 你也可以去city hall 查
他们欠的钱,包括税和水费,电费什么的,我们这里是花50块钱从city hall整个东西,他
们列明所有前房主欠city的钱, 在这日子之钱的前不用你负责(相当于和city的保险样,
所以这个在close 前1星期左右去办, 太早的话后来的钱你负责,太晚的话close是拿不
到就麻烦了, 我们的是前房主欠 7000 多)
3. 在Purchase & Sale agreement 上应该有详细的条款, 而且一定要请专门律师做,
不要请贷款公司免费的律师, 他们会在正常的Purchase & Sale agreement 后面补充规
定.

real property ownership形式有两种:
1. tenancy in common:每个owner具有相同的使用权,但所有权可以不同,适合未婚
者(或者独立投资人)一起买房的情况,比如A可以有80%interest,B则20%,但A不能
赶B出去,B可以使用property所有的权益。以后卖的时候两人的interest不一样而已。
B去世的话,B的产权可以单独转移给C,A不能自动获得B的产权。
2. joint tenancy:每个owner具有相同使用权和interest。而且具有right of
survivorship。如果B去世,A自动获得B的产权。首先你们已经是夫妻,那么有一种特
殊的joint tenancy,叫做tenancies by the entirety。这种ownership只能created
by will or deed。deed必须写明,这个property是tenancies by the entirety。一般
来说如果是已婚夫妻一起买房,by default就是tenancies by the entirety。

provide a survey or abstract. Seller will transfer title with a

这个最后的Limited or Special Warranty Deed和general warranty有什么区别,那个

第一次买房子,不大懂,应该在purchase agreement怎么样把loan contingency给弄好

里面第2条的C享,“first loan in the amount of"..., 因为打算贷的FHA,agent没
有在(1)里面添任何东西,但是在(2)里面添了FHA loan 和5.25% discount points.具
体不知道什么意思,有人研究过吗?
具体如下:

买DUPLEX类型的CONDONIMUM要注意的问题:
刚给AGENT打电话了,要她给我们出个OFFER。可是新手买房,好象有点冒然,这是我们
的第一个OFFER。这个房子是两户共享一个MASTER DEED,并排连在一起的两个屋子,买
主没有LAND,两家的土地使用权在一个DEED上面。隔壁住着户印度人,带两个小孩(<
4岁)。
可是很担心这种不是大规模有正式HOME ASSOCIATION会带来很多潜在问题,比方说邻里
纠纷。
大家有啥提醒与建议吗,在我们正式出OFFER前。
