刚才google了一下,大家可以一起学习哈, 这篇文章是网上搜的,只是大致讲解一下,
具体每个州的规定最好是直接去看那个州具体的条文和案例。
很多州都有dog-bite status, 规定狗主人要对自家狗造成的伤害(不一定是bite)付
责任。基本来说,只要是狗对别人造成了伤害,不管主人当时是否试图阻止,都要付责
任。而受伤者也不用去举证狗主人做错了什么。
比如,明尼苏达的规定:
If a dog, without provocation, attacks or injures any person who is acting
peaceably in any place where the person may lawfully be, the owner of the
dog is liable in damages to the person so attacked or injured to the full
amount of the injury sustained.
受伤者必须证明:
1,自己因为对方狗而受伤(不一定是被咬,也许是冲着他吼导致他自己摔了一跤的话

真不明白,美国的言论自由有什么模糊不清的,还有人弄不清?这是很清楚的法律概念。
美国宪法第一修正案的原文如下:
Congress shall make no law respecting an establishment of religion, or
prohibiting the free exercise thereof; or abridging the freedom of speech,
or of the press; or the right of the people peaceably to assemble, and to
petition the Government for a redress of grievances.
也就是说政府不许制定任何管制言论的法律。由于美国是法治社会,既然没有法律管制
,当然政府就不能管制你的言论。仅此而已。
你要是说什么话被单位炒鱿鱼,那是活该。因为单位也有自己的自由,包括炒人鱿鱼的
自由。

首先吐两个槽。在网上一旦有人批评中国缺乏言论自由,总会有人说,美国也是如此,
还不如中国等等等。我就十分糊涂,因为我想问题的关键在于你认为言论自由好不好,
如果你说好,那么中国有没有言论自由与美国有何关系,难道因为美国没有,中国就可
以没有,美国是中国的榜样?我以为正确的做法就是不管哪个国家没有言论自由都应该
批评,这才是所谓的公正。可见有些人逻辑混乱到了什么程度。
记得有一回我反感有些人以祖为阴,马上有人就说:那我骂你祖宗八代,你难道可以无
动于衷。我觉得莫名其妙,因为我的意思是对历史人物要开放评价,不要搞什么诽谤罪
。我可完全没有料到有人会心里这样恶龊,首先想到的就是骂人,讨论应该就事论事,
为什么要骂人呢。

在他的推特下面,有支持和反对的网友你来我往,讨论各种议题。不少看不惯特朗普的
网友、大V,也在特朗普的推特底下骂骂总统。
一向心直口快的特朗普怎么能容忍这些人在自己的推特底下骂自己呢?于是,他做了每
个网友都会做的事儿——把这些人拉黑。
这一拉黑不要紧,却让特朗普惹上了“违宪”的嫌疑。
据每日经济新闻网站6月7日援引美国《国会山报》当地时间6日报道,美国哥伦比亚大
学的第一修正案骑士团(真的是骑士团哦~The Knight First Amendment Institute)
组织向特朗普写信,要求特朗普“解放”那些被拉黑的人。

美国的各州都有不同的国旗保护法,不同时期都有人因焚烧或玷污国旗入狱和获罪,但
是罪名最终都被最高法院推翻了。2000 年3月,美国参议院投票表决有超过80%的民众
支持的国旗修正案,这个修正案要求改变一贯做法,决定对侮辱国旗的人判罪。最后,
由于未能达到三分之二的多 数而搁浅。这是美国参议院第三次就是否在宪法中增加保
护国旗的条款进行投票表决,前两次分别是1990年和1995年。两次表决,分别以63对36
(一人 未参加投票)和58对42未能通过。
1966年6月6日,纽约黑人西德尼·司曲特从广播中听到,第一个进入密西西比大学读书
的黑人詹姆斯·梅乐迪什遭到枪击。他愤怒地走上街头,当众焚烧了一面美国国旗,并
高喊“我们不要他妈的国旗!” 他因违反纽约国旗保护法而被捕,并被判有罪。但最高
法院推翻了这项判决。
1966年,纽约市艺术长廊的主人斯蒂芬·拉迪什因展出三尊包着美国国旗的雕像而被捕
。国旗包裹的分别为子弹箱,吊在绳圈中的人形和男性生殖器。他也被控违反了国旗法
。最高法院的表决是4对4(一位法官没有参加投票),没有判决结果。后来拉迪什说服

多谢指教。但是first amendament 原文是限制国会立法的,又不是说总统不能表达个
人观点
Congress shall make no law respecting an establishment of religion, or
prohibiting the free exercise thereof; or abridging the freedom of speech,
or of the press; or the right of the people peaceably to assemble, and to
petition the Government for a redress of grievances.
此外我在article II中也没有看到总统不能表达个人观点的选项。
所以,我依然认为,宪政危机并不存在。
