我来说说上交通庭的过程吧。（纽约市内，其他地方可能略有不同）
首先罚单上有几个地址，包括寄钱及听证（hearing，就是交通庭）。
上交通庭不需预约，不用交费，但有期限（一般是拿到罚单30天内）。
进去后你可以选择：
1）直接去cashier交钱，既然来了一般都会要求见官；
2）领号码，填表，等叫号，然后见到的还不是法官，而是adjuster，
一般adjuster什么都不问，在电脑上输入你的信息后就问你是
guilty or not guilty。如果你承认guilty，他会给你20％－30％的折扣，
比如42刀可能只要交27刀，然后不用见官就可以走人了。如果你坚持
not guilty，他会告诉你去那个hearing room见官，官判你败诉的话，
你就要付全额罚单，没有折扣了。
3）到hearing room排队，一般法官会让你出示证据，陈述事实之前，
还要举手发誓。证据越多越好，陈述越简明越好。

拍照到现在5周，我还未收到照片以及罚单，网上也查不到记录，也许是处理慢或者拍
照都在闪灯瞬间进行，由于我发愣过了n秒才右转没拍上？大家有在LA被拍照的罚单么
，通常都多久收到？
今天早上去上庭解决unsafe lane change的罚单，原定时间10：00，我大概9：20就到
了，进去一看，法官还没来。sign up之后找座位坐下，不一会法官来了，开始进行8：
30的那场（OMG，迟这么久）。这一场大部分都是拿到罚单按照第一次出庭due date来
的，好多人就plead guilty然后去交钱。有些人说自己没钱啊啥的延期，或者改成社区
服务。10：00的庭大概都是这种not guilty plea的，警察们在10：00陆陆续续都到了
，共来了至少15个！！法庭里面管事的人就开始点名，询问是否愿意plead guilty或者
proceed，有的人继续，有的人可能看到逮自己的警察来了就plead guilty了，交钱。
过一会我被点到名字，我原以为也是问我是要认罪还是继续，正准备回答，结果被告知

answer, "guilty/not guilty/no contest". if you plea not guilty, a real
court date will be set for trial.
arraignment can be done via mail. send in a check with the bail amount,
and write Not Guilty on the check. but you need to do that weeks in

一般去法庭，可以博警察不来，你就直接dismissed。
如果警察来了，就看情况。
如果你有证据，或者有一肚子理由，并且都是valid理由，那么就plead not guilty.
然后可能会另选时间开庭。你可以找律师，律师费当然鸟贵。你也可以自己申诉。按照
你前面说明的情况，你可以强调在当时的情况下，停车反而危险。紧急刹车会导致你脑
震荡什么的。法官不会因为你plead not guilty而多判。
如果你觉得自己口才不够好，法律知识又不太懂，那么就no contest或者plead guilty
with explanation. 当然，开庭之前，你应该可以有机会找prosecutor谈一下。各法
庭不同，不过你可以bargain一个合理的结果，目的就是不扣分，罚款也就算了。如果
又要扣分又要罚款的，就不要接受bargain，plead not guilty.
有的法庭开庭前会给你机会找prosecutor谈，有的是要等法官叫你名字了，你再去谈，
反正你一定要早早地去，提早1个小时去，最好你的名字被叫到了警察没来，你就赚了。

我那天开车回Logan，然后到Logan的时候，有个警车跟着我跑，我当时就纳闷了，我又
没超速又没闯红灯啊什么的，干嘛跟我？然后警察告诉我：他的电脑里面显示到我的车
子没有上保！然后警察说我要去court和法官说清楚。
然后我打电话给保险公司问怎么回事，原来是我在买车之前，先买的保险，然后等我买
到车子了，我忘记和保险公司更新我车子的信息了，我只更新了我的驾照信息，之前以
为有了驾照信息保险公司会自动更新车子信息。所以我完全不知情，然后保险公司也不
能证明我在Pull over之前这个车子有上保，他们只能证明我买了auto保险。
重点是，我出庭那天，法官问我想证明自己guilty 还是 Not guilty,我选择了not
guilty.然后他就给我安排了一个pre-trail.应该就是一个mediation吧。
可是请问下各位：这种情况我应该怎么处理？我确实没办法证明我是not guilty.可是
在我买保险的时候，以为更新了驾照就OK了，这可以算我不知情吗？哎呀呀，我现在脑
子里面一塌糊涂，觉得自己好委屈！每个月都交了100多的保险，结果还要出这种事！

有没有你的ticket，要交多少钱。
你应该做Trial by Written Declaration。如果Trial by Written Declaration输了再
重新上庭。
这样的案件分成两部分：arraignment（就是你plead guilty或not guilty）和trial。
为了arraignment，你可以亲自去法庭，跟clerk说你要plead not guilty，交罚款，跟
着要求Trial by Written Declaration。你也可以通过邮件plead not guilty，交罚款
，和要求Trial by Written Declaration。
他们到时候寄Trial by Written Decaration表给你之后，你有大概三个星期写好
declaration，寄回去。 |

认责任的时候估计保险也认为是我的责任. 估计要我承担对方的损失. 但是我没有直接
PAY TICKET,而是GO TO COURT TRIAL,请了一个律师.前天COURT TRIAL结果是我NO
GUILTY. 律师说是警察和当事人都没有去.所以就NO GUILTY.
1请问这个NO GUILTY是什么意思呢, 是指我没有这个TICKET吗? 还是说COURT会把这个
TICKET 报告我所在州的DMV呢? NO GUILTY会影响我的DRIVING RECORD吗? 我知道
DISMISS是不会影响的,但不知道这个.
2我能否以COURT的结果给保险公司,希望保险公司不要把责任算在我头上呢? 至少可以
责任对半,各自保险付各自的. 可以吗?
因为我觉得COURT的判决应该是最后也是最OFFICIAL 的结果吧
请有经验的帮忙解释一下

1.还有可能面临什么严重处罚？
2.还有argue的余地吗？他当时并没有给我看reading，我也不知道他怎么测出来的。
3.这个记录一定会涨保险吗？我觉得挺严重的，我怎么做才能降低影响呢？

当时情况是老婆怀孕8个月坐车感觉肚子不舒服，想急着赶回家开快了点，
而且被pull的时候正在超18轮，就开到了80+了。
警察给了ticket，上面说明超速因为老婆不舒服，
ticket可以选择mail plea guilty/not guilty或者到时直接出庭。
请问这种情况应该怎么做比较好？

上个月有天下雨路滑，出i95去78e的时候有个大弯一踩刹车轮胎锁死直接装在路肩上了
，车是total了，警察来了给了一张damage of turnpike property的罚单，让去court
。去了第一次在Customer service等了俩小时拿到了这周三去上庭的通知。周三去了之
后又等了俩小时才排到，问guilty or not guilty，我说not guilty，然后法官直接说
2.9再来trial。我说那我认罪行吗，法官说你是怎么damage porperty的，我说
blablabla，法官一听，说车祸啊，那你认罪还是不认罪都得2.9再来一趟。。。
看之前的帖子说nj没有警察不来就给dismiss的规定？那我下次去的话警察要是还不在

发现被照了像。一直担心会不会收到citation。眼看一个星期快过去了，还想是不是就
没事了。没想到该发生的事还是发生了。在周末收到了citation。citation 上有几个
选项，（1） 交罚款（470刀）外加 traffic school （2）上法庭（给了时间）。
在citation 上附有四张照片。第一张照片有驾驶员的头像，第二张照片显示车牌号，
第三张照片显示车头在limit line 后，红灯时间（0.18 seconds）， 车速 （23mph),
第四张照片显示车尾在limit line 后，红灯时间（0.79 seconds）， 车速 （23mph),
第三张照片和第四张照片的间隔时间（0.6 seconds).
我能很确定的说，交通灯是在我向左转过了limit line 五六个feet 后变红的。但是不
知什么原因，第三张照片显示车头在limit line 后，交通灯时间已经红了0.18
seconds。我觉得这个系统有些问题。

today. If you have a good record, you'll get no points. If you pay or go to
school, you'll get no points but you are "GUILTY" which will stay on your
record.
By going to court or hire a lawyer, you'll end up "no contest', which means
"not guilty or guilty". If you do not got to court, you admitted "guilty".
I gave my past two speeding ticket to a lawyer and paid court fees at the
end, no points.

去隔壁交钱就行，没钱，ok，给你个dead line那天前交就行

not guilty会有正式trial，警察不在自动胜，没你说的这种警察不在还败的

上个月有天下雨路滑，出i95去78e的时候有个大弯一踩刹车轮胎锁死直接装在路肩上了
，车是total了，警察来了给了一张damage of turnpike property的罚单，让去court
。去了第一次在Customer service等了俩小时拿到了这周三去上庭的通知。周三去了之
后又等了俩小时才排到，问guilty or not guilty，我说not guilty，然后法官直接说
2.9再来trial。我说那我认罪行吗，法官说你是怎么damage porperty的，我说
blablabla，法官一听，说车祸啊，那你认罪还是不认罪都得2.9再来一趟。。。
看之前的帖子说nj没有警察不来就给dismiss的规定？那我下次去的话警察要是还不在
又得再来一次？这种事情到底要不要认guilty啊，会有什么后果？要不要去请律师啊？
法庭还是在newark，每次去都觉得瘆的慌。。。 |

给的通知是10月27日前必须把单子寄回法庭。
违章代码1180D，扣4分的级别。
因为八月份刚从外州搬过来，不太清楚在纽约州speeding的严重性，所以一直没管。今
天去问了学校免费法律援助的律师，感觉比想象中严重得多。我超速的地点离家很远，
律师无法代我出庭。
1. 之前不知道纽约驾照有Probation，期间违章会被吊销。参加路考的新司机都会知道
，但我的驾照是从外州转到纽约的。不知道像我这种情况如果plead guilty会被吊销驾
照吗？ DMV网站上只写了路考得驾照的新司机的情况。
2.我问了律师，尽管已经过了48小时（plead not guilty需要在接到单子后的48小时内
寄出），但律师还是信心满满说这种事情见得多了，在27日前寄出去就行，plead not
guilty. 大家觉得我应该plead guilty吗？
