对朱令的案件关心了很久。最初是在报上看到清华女生得了怪病生命垂危，通过互联网
的帮助被确诊为铊中毒。以后又读到清华另一女生孙维被怀疑为投毒人，但因为权力的
干预而逍遥法外。再后来又陆续了解到案情和受害者家庭情况。这一阵子网上又开始炒
作该案。因为对这个案子的关心，我也思考过很久，也读到过这十几年来涉情人们的种
种反应。通过思考我认为，孙维的涉嫌可能性很低。这个案子需要换一个思路去解决。
这篇文章中，我将讨论孙维作案可能性低的原因。
首先要确立到底是几次中毒的问题。说一次中毒的目前来看缺乏依据。另一个问题是，
如果是二次中毒的话，第二次中毒发生在什么时间段。有人说两次中毒都发生在朱令第
一次发病前。但是目前我还没有发现临床病例可以支持这个说法。从临床表现来看，第
二次中毒应该发生在朱令返校后到二次发病前这段时间。当然，还有一个毒源地问题。

我上面明确说了“对着法庭plead guilty”，就是说在plea阶段对着法庭作出的才叫
guilty plea。有guilty plea直接就定罪了。所以这是confession直接定罪的一种情况。
2. OJ当然可以plead not guilty，那就进入审判。审判中检察官可以传唤警察作证，
警察可以这样作证：”OJ跟我承认了人是他杀的。“ 警察的这个证词就成为了证据的
一部分，只依靠这个证据本身够不够定罪那是陪审团要考虑的事情。通常只有
confession不足够定罪，虽然confession算是比较强的证据， 但是这样一句证词通常
来说没有强到prove beyond a reasonable doubt。所以检察官还会加入其它证据进行
佐证，多项证据互相印证以求达到prove beyond a reasonable doubt。
但是警察的证词，也就是OJ的confession，确实是证据的一部分，是要被陪审团考虑评

发帖数: 1486 | 11 你寄了ticket了吗？court至少得等到ticket上的截止日期之后，才会给你安排trial。
除非你plea guilty，不然你是不知道罚金是多少的。
流程应该是：
1. 寄出罚单（either guilty 或者 not guilty）。如果直接guilty了，那就等着收罚
金就对了，一般没必要直接就guilty
2.suppose你plea not guilty，同样寄出ticket，等court给你回信，会给你个bargain
的单子让你填，同时通知你一个日期，可以和prosecutor当面谈。你可以选择填了
bargain，然后等bargain回来的结果，一般就是减到上贴说的罪行，并且会告诉你罚金
是多少。如果你不同意，那么需要跟court联系，schedule个trial的时间。如果同意了
，那就直接认罪交罚金了事。
看样子，你一直连ticket都没寄走？那你最好打个电话问问，有可能电话里给你个
bargain，也有可能非要让你meet in person。好像规定是不能和prosecutor电话里谈
论ticket的。 |

带monthly pass，坐light rail的时候查票被拦了下来，写了单下周五要上court，想
问一下上court的时候要不要认guilty?
我自己是这样考虑的，虽然我真的买了月票，但当时确实没带在身上，应该就是属于“
failture to display proof of payment upon request"，应该就是guilty了，所以我
倾向于承认guilty，但不知道认guilty、交罚款以后会不会影响留下什么纪录、影响
credit history之类的，于是有点纠结，到底要不要认guilty.....
另外，在认了guilty以后，还有机会申辩吗？例如把月票给法官看，解释当时赶时间送
小孩上学、而且换了个包所以忘带月票，这样有机会减低罚款额吗?
虽然以前在美国读过两年书，但一直基本就呆在学校，后来又回国两年了，这次再来，
没来两个月就遇上这事了，没有经验，心里没谱，希望有人能指点一下迷津啊，谢谢，

2: Uninsured (insurance card忘带了）- $109
请问各位两个问题：
1： 好像是说上网，还是怎样的，可以少付点钱，不知道具体怎么操作。
2： 警察当时说，我可以回去复印我的insurance card, 然后和TICKET一起寄出去，再
在ticket反面选个什么guilty or not guilty,就不用交钱。但我当时没留意他说的是
选guilty 还是not guilty, 现在看ticket反面，好像如果我选not guilty的话，“you
will be notified by mail of your hearing date, time and location".貌似要上
庭的说。如果我选guilty的话，难道还要交$109的罚单。。？
有哪位有过类似经历，能指点下吗？

这个对冲基金经理名叫Mathew Martoma。乍一看之下似乎是南欧或者南美人。实际上，

的泥？
原来这里另有一段佳话，让篡改简历的IT老印都自愧不如，至于琐男们，我不知道尔等

Ajai原来是哈佛法学院的学生。快毕业找工作时，Ajai非法黑进哈佛管理成绩的数据库
，改高了自己几门课的分数，随后把这些成绩发给了他正在申请职位的几个法院。
聪明伶俐的Ajai如愿以偿拿到了一所法院的职位。但是，DC法院的工作人员鬼使神差地
觉得Ajai成绩单可能有诈，就联系了哈佛。
Ajai得知此事，立刻干了两件事：
1。告知哈佛自己攻入学校计算机，篡改了成绩。但是他说这只是为了给他父母看，并
没有想到成绩被发给了法院。

试一试live bait吧，我就去车里取来渔网，撒了一些小的live baits，结果还搞上了
几条White Bass。钓不着，用网倒是搞上来了，于是就把White Bass给留下了。于是杯

刚刚给County Citation Office打电话了。人家问你是打算 plea guilty 还是not

Guility输入到她的电脑之前，她也不知道要多少的罚款，一定输入了guilty, 又不能

今天，我在某网站看到一则消息《李洪志在美国认罪（图）》，称：2006年2月27日，
李 洪志因驾车未系安全带而受到犯罪指控。桉件由美国新墨西哥州法院开庭审理，随
后，由于李洪 志未按时出庭，受到了第2项指控。2006年4月17日，李洪志签署了认罪
书，并支付了罚款，承担诉讼费用。并称，曾经李 洪 志2008年6月因交通犯罪在美国
受罚的记录，那次李 洪 志因超速在美国弗吉尼亚州史密斯县地区法院受罚。
对此，我这就纳闷了这个自称“法力比释迦牟尼要高几百倍、几万倍”，甚至还自吹
“我的根都扎在宇宙上，谁能动得了你，我就能动得了你”的神通广大、无所不能“宇
宙主佛”怎么居然就斗不过这些凡人的交通警察和法院法官呢？还向他们乖乖的低头认
罪！这岂不是神仙向凡人认罪！古今未有，新鲜啊！
这一切说明了什么呢？只能说明他所鼓吹的什么他的“法力比释迦牟尼要高几百倍、几
万倍” 什么夸耀他“具大神通，有搬运、定物、思维控制、隐身等功能”统统都是骗
人的鬼话，根本就经不起凡人一个小小的交通事故的处罚就便“原形毕露”了！

填了地址，也没有告诉我她说的那个conference的时间，说3到6个月才能收到信告诉我
时间，那多慢啊。而且也多了一个步骤，周围别的法庭都是第一次去交罚单的时候就可
以直接见到prosecutor和谈判的。
还有今天那个前台只是我问我gulity or no guilty,可是在单子背面也没有让我选择打
对勾，只是说我在最下面那行填了我的地址，我现在还担心，我说的no guilty她要是
听成guilty就麻烦了，因为我问过她如果guilty是罚多少钱，扣多少分。 |

guilty and paying the fine by **/**/**** without a court appearance; 2)
enter a plea of not guilty, in writing below. This matter would then be
scheduled for a Court Trial and notice would be mailed to you. You would be
required to be present. The prosecuting attorney and the arresting officer
would also be present; 3) Appear before the Court on **/**/**** and offer
this explanation on the record.

如果我选guilty, 就马上付钱，扣点。或要求拿钱买点（100多刀一点），300多刀拿下
。事情完结。
选no guilty, 如警察不出庭，一切结束，我不扣点不交钱。如出庭，我输，付钱并扣
点。可要求拿钱买点，也是要300多刀。
选guilty但explain --- 这方面我还不知道应该是怎么样的。请懂的大侠指教。
另：还有人说可在开庭前去找prosecuter，让他帮忙把这种扣点的guilty转换成另一个
罚款多但不扣点的guilty. 通常150－200刀的罚款那种。
我目前了解到的东西如上，但不知道是否正确，请知道的朋友们多给一些信息，多谢了

59/40，safe corridor， 四点
警察没来，法官问guilty还是no guilty， 我说no guilty， 法官说那你改天再来，我
们会给你发信告诉你哪天。 然后我就出来了。 很奇怪， 看大家经验，不是警察不来
，罚单就免了吗？ 我这个怎么还让我再来啊？
还有就是罚了的四点， 有个女的（不知道怎么称呼，法官面前两个桌，一个是被告，
她站在另外一个桌，但她不是警察），法官中间出去休息时， 她叫我过去，问我消不
消点，四点全消，400块，消两点， 100~150。 我开始说消两点， 后来听旁边的人说
不论几点，有点就很麻烦，就又跟那女的说消四点。 旁边的人说，如果不消点， 保险
会涨的很厉害，有个什么surcharge， 两个点surcharge就得250每年，而且得交三年。
算下来还不如400块把点全消了。请问大家是这样吗？ 这个罚点到底有多严重啊？
还有就是今天说no guilty,下次警察如果来，如果被判 guilty了，是不是会被判的更
重啊？ 我今天只是说超了些，但没有超那么多。

刚刚从Superior Court回来，觉得这个经历很有意思，值得跟大家分享和总结一下。
先说我的case，最后会给大家总结步骤性的对策。
加州，11月，黄灯和红灯交接时候，右转，没有full stop, 被拍。当时想要是ticket
来了一定跟它argue。因为我以前见过一个人在那个intersection被拍，那个人直接傻
了，停在路中间不知道自己为什么被闪，我也傻了，因为在那个intersection, 我见过
N多人红灯右转不停没有被拍，为什么他被拍？
Anyway, 12月拿到traffic violation notice. 有4张照片，有驾车人的正面照片，车
牌号等。另附车速等信息。这不是ticekt, 只是问这个人是不是你。
照片很清楚（表情还不错，哈~），本人也比较实诚，所以我回信说是我。
然后ticket就来了，$486, traffic school 再另加$54。除了用S甚至F word骂破产的

发帖数: 1347 | 49 今天去机场，心急了点，忘记注意限速15mile，结果超速3倍，开了45mile。警察开了
110块的citation，说可以plea guilty or no guilty，如果plea guilty，交钱就
完事了，如果plea no guilty，得上庭。想问问这个citation是不是就是ticket啊？如果
plea no guilty的话，是不是会记点？罚款上没有写记点，也没有写超速的速度，只说
driving too fast。
