Fairfield的时候被抓，说65/85，严重怀疑是否85m/h这么高，但确实是超速了。停车
时候跟警察说小朋友哭得厉害没有注意，希望他放我一马，不管用。后来跟朋友聊起时
都说80号公路就Fairfield辖区的CHP工作特别卖力--穷山恶水出刁民？
一段时间后收到法院的信，要交$360 or上庭。借了本how to fight and win your
ticket at California看，里面提及被抓的时候其实可以要求CHP让你去county seat出
庭-就是常住地的法庭，这样我就可以不用开车1个多小时去Fairfield了，可惜当时不
知道有这么一个法例。当然，警察拒绝的话还是要去他所辖区的法庭上庭。研究了一下
那本书，在限速65的freeway可以argue的地方不多，还是按照书的要求让警察提供当天
的notes.决定上庭。
上庭前还没有收到CHP的notes,在犹豫是plea guilty or no guilty.Plea guilty的话

周二就让你出庭？还是说收到ticket以后，10天内与court联系？基本上看你的情况，
你接到ticket以后，除了问朋友，你啥都没干。仔细看你的ticket了没有？警察cite的
是什么？cite的原文跟ticket上citation number一致不？ticket上对你本人和你的车
的基本信息是否正确？
我觉得你所谓的周二上庭，不过就是去make plea。你那个是哪家法庭，那个法庭给你
啥option我不知道，但是德州很多法庭是允许你选plea guilty, no contest或no
guilty的。如果可选no contest, 你还可以选defensive driving或parole，交
discounted或full罚款不用上庭,不影响你的保险，就算把事了了。如果你那个法庭只
有guilty或not guilty, 你要研究一下，看看这个法庭的程序，如果选了not guilty以
后，有没有啥pretrial，如果有pretrial，那基本上就是plea bargain的过程。

人在PA。老公带着我和两个老妈去outlet血拼一天，回程已是晚上。在一个限速55的
local上开，一个下坡底部有个红绿灯。快到的时候（至少我觉得是）绿灯变黄，老公
觉得刹不住了直接冲了过去，可能在过线之前或者马上过线的时候红灯了。刚过就被
F150晃瞎趴住。
老公对警察说this is a judgement call，毕竟开车最忌讳的就是犹豫。警察倒是很
nice,不停地告诉老公relax，you're doing fine，说记录很好，第一次被趴，给你个
citation。就是批评教育的目的，看见黄灯的时候要有刹车的意识。说不影响我的记录
也不会上报pennDOT。不过得在十天之内Plead guilty or not。给了粉色的citation，
当时自己还说哦我这个单子拿错了，你就照着上面做就好了。我们以为没有记录，就没
当回事，结果回来仔细看了看，有一百多刀的罚款。。。查了一下发现citation还是有
记录的。
问题：
1.Plead guilty or not？我觉得他抓我们也是出于无聊，他也说就是正好看见了就抓
一下，this is his job。

人，给他开罚单的警察跟我的警察不是同一个人，而到庭的警察只有一个，所以我推断
，警察一般都不会出席。只是，每次有一个警察在法庭值班，我第一次的时候，碰巧是
给我开罚单的警察值班，或者他开罚单的时候，给我定点出庭日期就是选的他值班的日
期也为可知。
我观察到情况，所以到庭的违章者，没有一个和警察对质的。所有人都选择plea not
guilty, 然后去hall way等着跟prosecutor面谈，确定减免结果。其中有一个人，估计
也是第一出庭，搞不清楚究竟应该plea guilty还是plea not guilty.女法官跟他反复
解释情况，说我觉得你应该plea not guilty，然后他又墨迹了半天，半推半就地同意

变这个。
以前也有人问过关于这个一模一样的几句话。觉得有可能是想说If your appearance
is mandatory才you are not eligible for
a Trial by Declaration，但是打的语法不好，漏了“and”和多了个句号。（但是其
实这样也是错的。就算arraignment的appearance是mandatory，trial也可以是by
written declaration的。）
反正你不用管就是了。
arraignment就是plead guilty或not guilty的。可以亲自去arraignment或通过邮件
plead guilty或not guilty。跟着如果你plead not guilty就有trial。trial可以in
court或by written declaration。（跟着如果by written declaration输了还可以要

开到85，给了一张罚单。情况如下：
1）我记得当时是在从左道超车，然后又马上回到右道。超车时应该有 75到80， 但是
应该没有到85.
2）罚单上写的是"Disobey Traffic Control device", 1110A., 没有写明我是
speeding， 也没有写我超速多少。也没有相关的“supporting deposition” 给我。
罚单上有一栏“Radar Officer Signature”也是空白的。
3）我是加拿大魁北克的车牌。
有几个问题请教一下：
1）我这个是speeding的罚单吗？会发多少钱？会扣点吗？（纽约的罚单怎么影响魁省
的驾照点数呢？）当时问警察会罚多少钱， 警察说不知道，法官会决定。
2）找大家的经验，我应该“Plea guilty” 还是 “Plea not guilty”？

如果我选guilty, 就马上付钱，扣点。或要求拿钱买点（100多刀一点），300多刀拿下
。事情完结。
选no guilty, 如警察不出庭，一切结束，我不扣点不交钱。如出庭，我输，付钱并扣
点。可要求拿钱买点，也是要300多刀。
选guilty但explain --- 这方面我还不知道应该是怎么样的。请懂的大侠指教。
另：还有人说可在开庭前去找prosecuter，让他帮忙把这种扣点的guilty转换成另一个
罚款多但不扣点的guilty. 通常150－200刀的罚款那种。
我目前了解到的东西如上，但不知道是否正确，请知道的朋友们多给一些信息，多谢了

人有个借鉴，我没有什么经验，而且没有argue成功，所以应该只有教训，请大家点评！
开车不想被罚，还是要时时刻刻遵守交规！

就是在loveland超速，然后被罚4分，交135刀，ticket上还有一个选择就是在上厅前把
罚单交了，只扣2分，罚110刀。
参考了一些以前的帖子貌似大家都说只要是你的第一张罚单，一般上庭都是给免分的，
而且甚至连罚款也不会交，我就抱着试试的目的今天上午去了。
进去有一个老大爷出来宣布一下法庭的注意事项，今天目测有15个人所有，有些是陪着
来的，没人说话嬉笑，很严肃。大爷会给没人发一个张纸上面写得你的权力还义务，不
用看，签名就行了。
法庭上写着，你有四个选择：1， plea guilty, 2. no guilty，然后会给你安排个审

guilty. The court clerk told me that 如果我plea not guilty, 但上庭被判
guilty,那罚款会远远高于$111, it may be up to $1000 or put in jail. I was
scaled by what she said.
I still plead not guilty, and chose non-jury trial without attorney.
My question is:
1. If I am judged as guilty in the trial, do I really need to pay much more
than $111 or even be put in jail?
2. Should I hire an atterney?
3. Do I make the right choice by selecting non-jury trial?

上庭第一种可能是你去了警察不去，你的case会被dismiss，你就没事了。这种情况你
就回来给我发包子。
第二种情况，你plead guilty with explanation，你和法官说两件事情，你的driving
record很好，是触犯（当然这得是事实），第二你当天有什么因素影响了你，比如那
儿没灯太暗，或者stop sign被挡住之类。法官会find you guilty，但减免罪行，相应
减免一些fine，其实因为你要叫court fee，所以总体算起来和你不上庭就付钱是差不
多的，好处是罪行轻重影响你会被罚多少points
第三种情况，你plead not guilty，法官会让你和警察宣誓，i testify truth but
only truth。然后你就先说你的理由如何不guilty了，你当然是说你明明停车了，警察
说得不对，然后警察就需要出示证据，证明你没停，他若没有，你就赢了，因为美国法

女的家暴，女的打911，结果警察来了询问检查，是女的打男的，把女的逮捕了。 同事
是特较真的人，跟我们唠叨过程
最后一半认为女的guilty，一半认为not guilty (5个大妈）
最后大妈们坚持说女的打人没事，然后几个男的说老子明天上班don't care，not
guilty就not guilty吧
同事死倔，最后mistrial了。
大部分人没这么倔的，应该就not guilty了，这么小的案子如果mistrial多半检方也
drop charge了。
所以，女的打男的，想被判罪，太难了。
相反男的打女的，一般很轻松就能获罪 |

话说某日有同志闯了个红灯，不过他不是故意也不是不小心。当天下瓢泼大雨，限速55的路上他要左拐，左拐灯的黄灯只有3秒，该同志在黄灯变红灯的一霎那正好在不到线一点点的地方，简而言之，这位同志闯了个0.1秒的左转红灯。
过了若干天后该同志收到了ticket，，附有照片，包括车牌、司机脸部特写等。ticket价格400多刀，并且要上traffic school，好像要个admission fee大概50多刀。该同志觉着这张ticket够吃一个多月的饭了，而且上traffic school实验室老板会不爽，所以想着干脆去fight一下啦。
先是根据ticket上提供的信息去hearing。hearing很简单，主要就是问你是plea
guilty or not guilty。一般来说，如果plea guilty，罚单会略减，400多的减到300多，并罚上traffic school。如果plea not guilty，那就trial了。

几乎任何问题都可以的...
你就算没有相关知识，也看过电视剧吧，那里面很多虚构，
但是如下场景是真实的
法官问，jury，请问这个人guilty吗？jury回答，guilty/not guilty
这就是法官请询陪审团做判决，非常常见。
就算事实确凿，陪审团一样可以verdict not guilty，甚至
闭门会议集体为被告找理由，然后集体vote no guitlty. |

最近有一条新闻，说几个亚洲的平板显示器企业被美国司法当局制裁，最终庭外和解。
所谓和解，实际是这些企业认罪付了罚款，以避免后续的司法程序。
哪几个企业呢，这三个：AUO，LG和东芝。这三个企业中，估计后两个大家都知道，而
且在今天米国任何一家大的电器店里面都可以看到他们品牌的平板显示器。但是这第一
个AUO呢？不但在美国看不到任何这个品牌的显示器在销售，事实上他们其实主要是给
其他那些品牌代工贴牌的OEM厂商，这家企业是家华人企业，是台湾的友达。
几天前在ENGADGET上第一次看到该条新闻的时候，我先注意到的是那个新闻的配图，那
个图上是台北的中正广场，后来民进党去蒋化改名为了自由广场。不知是巧合还是有意
的配图，总之明眼人一看就知道那个新闻在突出台湾企业在操控面板价格。
