后10年就继续让律师做eb1a, 9月把很多新材料给律师后好久没有动静，11月问他们怎
么回事，结果发现他们10月中就给我们file了， 把pl要来一看，律师就把niw的信稍微
改了一下就交了，完全不是按我们想的写的，很不安。到了3月份终于等不下去，硬着
头皮叫了pp, 3月16号交 ，等了15天，最后一天终于等来了 rfe. officer: xm 1082
基本情况：
us PhD, 公司工作5年， 有3个专利， 都商业化成产品了， 期间作为 PI 拿了 2个
NIH的 grants, 2个USDA 的 grants. 公司还以我的技术为基础，拿到了国防部跟国安
部的合同。
律师claim 了
authorship : 有4篇文章，杂志都很好，但是引用不多，因为文章最后都申请了专利，
所以应用的人都是买的，没有什么引用的。
Judge: review了 18篇， 4，5个杂志，都是英文的。请来自中国跟韩国的2个编辑写了
信， 说明挑reviewer 的标准。

己开公司）一封，美国教授一封，两位编辑各一封。文章数目没有增加，引用从151增
加到了171次，审稿从31增加到了36次。虽然引用数目还行，但是，没有一个引用是大
家所认为的亮点。所有的推荐人没有一个业内的牛人。所审的稿，除了plos one用
google的排名，看起来还行，其它都是不知名期刊。律师建议在感恩节前送出RFE
response，好让移民官一边吃这火鸡肉，一边审我的案子。结果证明律师是正确的。我
只能说，自己比较幸运，碰到了比较好的移民官。

觉得那个Ball joint只是外面的橡胶囊上面有一点裂痕,并没有影响轮子的方向控制(没
有freeplay). 而且卖给我车的人在弗吉尼亚最近刚刚通过安全检查.
我刚刚来这里,也许对这里的情况不熟. 但是我觉得那种Inspection Station和
Service Station合在一起的地方当然希望要修的东西越多越好,这样他们可以多赚钱.
不知道大家能不能推荐一家Inspection only station. 也许这些inspection only
station为了多吸引顾客,标准会相对低一点吧.

后来人有帮助。很多时候我们尽自己最大的努力去准备，结果如何，交托上帝手中，将
一切的忧虑卸给神，因为祂顾念我们。相信或走或留，有神同在，都会走出一条恩典之
路来。
1. DIY 还是找律师？
各有利弊。我两年前申请NIW时的时候找了律师，律师帮忙写的推荐信。这次申请EB1A
是DIY，主要原因是律师不肯接，理由是引用不过100，把握不大。想想有了NIW的经验
，推荐信再改改，DIY的难度应该不大，于是就DIY了。在DIY的过程中，感觉对于相对
来说比较弱的case，DIY肯定比律师来弄把握更大，因为只有自己最了解自己，也对于
自己的申请更上心，更能挖掘出闪光点。如果你的case很强，属于肯定能过的，找律师
肯定更省心。下面的可以不用看了。
2. 怎么准备I-140的申请？
第一步：做足功课。

这3条是局部；international acclaim 是结果与整体。
这个新标准就是，虽然满足3条，但io可以主观性判定fmd还不足international

后说文章被引了很多次，列了4个比较多的引用次数。还有两个英文文章小奖（单位的
）。
问题是我的中文文章是02-06年发的，引用都是中文，250+，07年后，07年一篇英文，
09年两篇英文，只有07年的有4个独立引用。承认了national acclaim 和 achieved
extraordinary ability 但07年后没有sustained。IO的重点是07年后发的文章引用太
少，没有sustained national or international acclaim。
专业是Geoscience，引用是比较少，07年那篇和平均数差不多，09年两篇还没有独立的
引用，老大，请出出主意从其他方面证明sustained national or international
acclaim，award，media，和membership都是一般，没被承认，现在只有会议的session

还有一个是authorship。
今天收到了RFE，我的judge和authorship都过了，不过contribution需要补材料，说我
的引用少。实际上我引用的数目很多（independent>160），可是呢，有一半是知网的
，他们说，这些文章并没有引用我的（the submitted translation citations from
CNKI does not appear to cite your articles, rather the database was searched

Recommendation letters are usually used to prove contribution, international

专业: 化学, 美国top学校博士和博士后(很鸡肋, 申绿卡好像一点用处也没有)
文章: 15 英文, 6一作; 1 ACS年会报告.
引用: 总的220+, 独立160+, 有一些文章大段地引用了我的工作; 独立引用递了申请后
又涨了点, 但是不多, 只有接近10个.
推荐信: 4us+1canada+1australia, 3独立的. 准备推荐信时还不流行不要找大牛, 所
以推荐人基本上都是大牛, 还有一个诺奖得主, 还好没有被悲剧地跟推荐人比.
审稿: 40+, 杂志有8个, 水平都还可以; 递了申请后又多了5个审稿和一个杂志.

contribution，review和publication三项要求，但是不承认满足sustained acclaim和

1. Publication：10篇文章，19篇会议摘要。
2. contribution：102次引用
3. review：初始提交了2个review，RFE中提交了13个review。

，不要阿隐晦。
你其它的推荐信也可以一样的提到，以不同的方式说你有international acclaim，然
后由于你的international acclaim and reputation，你得到了杂志的邀请审稿。然后
以其它的推荐人的嘴巴说你审的杂志多高大上。

intent to deny clearly states that I meet three of six criteria
1) Scholarly articles, 2) Peer-review and 3) Scholarly contributions.
The Intent to Deny (IOD) then continues to say that taken together the
