， 16个review。求版内的xdjm帮忙看看还有救吗？还是取消申请？
以下是NOID的内容：
Although the beneficiary peer-reviewed 16 times for the ……(7 different
journal names), because peer review is routine in the field and, by itself,
is not indicative of or consistent with sustained national or international
acclaim, then USCIS cannot conclude that the beneficiary’s peer-review is
consistent with either a ‘level of expertise indicating that the individual
is one of that small percentage who have risen to the very top of the field
of endeavor’ or ‘sustained national or international acclaim’. The
evidence must set the beneficiary apart from others in his field.
While the record reflects the beneficiary has co-authored 14 scholarly
articles with a citation following, USCIS cannot conclude that the
beneficiary’s publication record is consistent with sustained national or
international acclaim nor can we state that the beneficiary is among that
small percentage at the very top of the field of endeavor. When compared to
the accomplishments of some of the beneficiary ‘s expert witnesses; i.e, in
addition to pubishing several scientific papers in peer review journals,
professor…, has ‘more than 30 patents’, while professor.. has published 7
books; it appears that the highest level of beneficiary’s field is far
above the level he has attained.
As discussed, USCIS has evaluated the evidence and determined that the
evidence does not establish that beneficiary is an individual of
extraordinary ability in accordance with 203(b)(1)(A)(i)of the INA.
Additionally, as required by (b)(1)(A)(ii) of INA, the beneficiary must seek
to enter the US to continue work in the claimed area of expertise. Although
no offer of employment is required for this classification, it must be
established that the beneficiary is coming to the US to continue work in
their field of expertise.
Please submit evidence that the beneficiary is coming to the US to continue
work in his field of expertise. Evidence that may be submitted to satisfy
this requirement includes, but is not limited to:
1, letters from current or prospective employers;
2, employment contracts; or
3, a statement from the beneficiary detailing plans on how he intends to
continue work in the US.
Furthermore, as request by (b)(1)(A)(iii) of the INA, the beneficiary’s
entry into the US must substantially benefit prospectively by US.
Please submit evidence that the beneficiary’s entry will substantially
benefit prospectively the US. Evidence that may be submitted to satisfy this
requirement includes, but is not limited to:
1, letters from current or prospective employers, or individuals who work in
the beneficiary’s field;
2, other evidence explaining how the beneficiary’s work will be
advantageous and of use to the interests of the US on a national level; or
3, a statement from the beneficiary detailing plans on how he will
substantially benefit prospectively the US.
Lastly, pursuant to section 291 of INA, whenever any person makes an
application for an immigration benefit, they shall bear the burden of proof
to establish eligibility. Accordingly, the petitioner must prove by a
preponderance of the evidence, in other works, that it is more like than not
, that the beneficiary is fully qualify for the benefit sought. See Matter
of E-M- 20 I. &N. Dec. 77 (Comm. 1989). After a careful review and analysis
of all evidence within the record, USCIS finds that the petitioner has not
established eligibility for the benefit sought.
The petitioner is hereby notified that it is the NOID….

编辑的推荐信(因为你牛才选你做review的)
2) 指出那些professor发那么多paper，那么多patent是大group
结果，平均到每个人头上还没你多，再找几个推荐信强调一些
你牛
by the way,你的citation是多少啊，找几个cite你paper的人
再写写推荐信呗
3) 剩下的很简单了，学校的合同，你投出去的paper/abstract来强调
你会继续在这个行业工作

我的citation不多， 申请的时候60-70左右。
律师催着交钱。 我不知道胜算大不大， 如果不大的话， 就不想继续下去了。 但按
