Q:佣金是怎么分成的?
A:佣金相当于一个月的租金, 分别给4个parties抽成:
其中50%(相当于0.5个月的租金)给
1.tenant agent's company
2.tenant agent
剩下50%给
3.listing agent's company
4.listing agent
Q:佣金由谁出?
A:可以是全部都由房主出,可以是全部都由租客给,也可以是房主/租客每人各自出50/
50。
Q: 到底什么才能决定佣金由哪一边出?
A:市场决定 (和2方意愿决定)。
如果房源紧张,是house owner's market, 租客难以寻觅合适地点和房子, 经纪人跑
腿开门带看房和所花其他时间大部分是在帮助租客tenant找房落户,那基本上就由租客
出全部的佣金。
如果形势相反,市场上很多房源供应,或者房主希望能够早一点租出去,但难以找到信
用好的租客来住,那么基本上房主愿意花钱请经纪人带他们的熟客上门, 房主出全部

针对无理扣押金,你只需要写一封清楚的解释/威胁的信,用Certified Mail寄给他,
并要求收信人签字发给你,一般对方就会从了。
如果对方不从,去小额法庭告他,里面一般有专门处理Landlord/Tenant的部门,不用
请律师,咨询一下比较懂行的人就可以了。毕竟你这个金额比较小,对吧?

我半年前接替一名Rutgers学生的lease,搬到位于Harrison的一栋house2楼的一间房子
,lease原本是一年的,由于那个学生中途回国,我接下来时还剩半年租期,签了转租
的租约(就是原租约房东和所有房客签字,外加一份同意我加入的协议,由房东,我,
以及其他三个没搬走的Rutgers学生签字),我把押金给了那个搬走的学生,他的押金
还继续和其他三个人压在一起。同时我也付了那个搬走学生的PSEG押金,交给了那个负
责开户的Rutgers学生。

)。
房东说是我们两家租户共同的问题,要我们付费,如果HOA不管的话。总共要1千多。
我们加州法律说是tenant造成的损坏,要tenants负责修。但是这种情况是我的错,楼
上的错,我们楼上楼下tenants共同的错,或者nobody's fault(就是,时间久了下水管
道自然会被grease堵)?

如果是condo/apartment, 首先是找HOA. HOA master insurance usually covers the
walls and internal structure, 但不cover personal properties. Carpet属于
personal property. 如果HOA不cover,或者没有全部cover, 那么if he owns这个
condo,那ta应该是买了HO-6 home insurance的,就用HO6的coverage来cover,那个是
包括了both structures and personal properties的。 If he rents ,and if his
landlord买了rental insurance, owner's rental insurance should cover walls

在加州,最常见的夫妻 vest 房产权的方式是Joint Tenancy,也即Joint Tenancy (

否则,罚一倍,从你的情况看,它欺负你不懂法,给你寄的东西,过期了,不具备法律效力.
退押金也晚了,
去告它,MMD, 你狗狗small claims court拉.让它双倍的还你押金.
According to California Landlord Tenant Law, Under Civil Code Section 1950.5,
Within 21 days after tenant leave the unit, the landlord must refund your
full deposit. Also Under Civil Code Section 1950.5,

j****y 发帖数: 1714 | 40 前段时间搬出住了3年多的公寓,客厅地毯是被我家弄得很脏了。更惨的是自己洗地毯
的时候掉了bleach在进门的地方,很大一块颜色都不一样。 心里知道会被扣钱。
后来收到公寓的退款支票和扣款清单,但是没有提供任何证据。说扣款中包含换客厅地
毯花的$500刀。 我觉得太多了。就钻研了加州的tenant law. 发现加州还是比较保护
租房子的人。房东要扣钱必须提供itemized receipts,然后只能扣换的东西的剩余价
值(预期5年适用寿命的新地毯你用了3年,全部换的话租户也只负担2/5的费用)。
于是打电话要receipt, 后来又写了一封信 (附上做参考),当面送信,让公寓签字画
押说收到了这封信。 后来拿到所谓的receipts才发现公寓提供了两个receipts, 一个
是 换地毯的估价单 (price quote $500), 一个是补地毯的invoice ($100). 估价单的
