in the U.S. for the past 3 years (2014, 2013, 2012)
• 100% Days from Current Year (i.e. 2014)

我算出来的，恰好是183.6天。。
想问几个情况，
1. 首先，2013年和2012年都是B1的身份，绝对没有任何US source 收入。在美的日子
都要进行计算吧？
2. 其次，arrive day和departure day都要算进来吗？主要是不知道什么身份更合适。

OPT延期这个问题一直没有确切的答案。因此想把自己的经历给大家分享一下，也算提

背景：
博士毕业后在本校做薄厚，OPT 2010年1月开始，11年1月结束。
时间流程：
6月 提交了NIW的140。 因为学校已经答应办H1B. 早申请早排队
7月 学校告诉我因为prevailing wage的问题，H1B办不了了，不过他们建议我OPT延期
。虽然我非常怀
疑学校为了省H1B的申请费而故意逼我OPT延期，而且我知道140提交以后OPT延期可能会
有问题，但
是我也没有办法。我不能告诉学校我交了140，我怕ISS因为移民倾向拒绝发新的I20。

what the PD is.

07/08的Eb2基本不会受益。
09/10/11的Eb2能比正常快1年左右，10年的受益最多，近2年，12年的大致没啥受益。
13年以后的新Eb2就要跟着慢下来了，因为每年Eb2的需求超过6万，每年排期只能前进8
个月以上。以前中国Eb2是第二大国，是老印的一半，从2008年开始，中国就成了老三
，只有老印的5分之一，自己的2800名额差不多就够吃了，每年排期能至少前进12个月。
到了2011年,中国的Eb2就差不多只有老印的10%,每年的4万名额就是全给中印,中国也只
能分到3千多,不见得比没有3012好多少.
3012对中国Eb3是个噩梦。 |

Method
1. Potential EB2C demand：
NIU给了到12年9月位置批准的EB2C的140总数。因为很多EB1的申请者同时递交了NIW并
且都获得了批准，所以这些EB2C-NIW的140不会变成485。
Prior to 2010的demand已经知道为4,275（未除去上个月reduce的demand）。
根据10年1-4月的demand数据（825）可以推测10年的总demand应该是825X3=2475。而10
年批准的140为3002。由此可以估测有效140比例为2475/3002 = 82.45%。10-12年9月的
demand可据此估算为(3002+4368+2641)x82.45% = 8254。也就是说Prior to 10/2012的
总demand为10729。

我们已经在James cancer center约好肿瘤外科医生准备12月手术
我过去的几年里一直使用学校的student insurance, 老婆来美国以后学校要求她也加
入我的insurance plan, 所以我老婆也在我的insurance plan里面.
但是最近收到保险公司的信, 说需要证明我们过去的12个月也一直under insurance
coverage, 否则的话,这次的claim就要算作pre-existing condition 然后以后所有
subsequent claims都要被deny.

的官司，媒体和大家围绕讨论的，简单了概括就是他们各自每个屏幕对角线的长度这样
的内容，然后大家都来阵阵有词的说苹果欺负人，再专业点的人也就是说什么“prior
art"前例。
我们就来说说这个prior art前例。以触摸屏的使用为例。注意苹果这里注册专利的不
是简单液晶显示触摸屏，偷换概念的讨论没有意义。苹果注册的应该是键盘由触摸屏上
显示产生，而非需要手机上再配一个物理键盘。
根据最近三星苹果专利官司的部分新闻，我注意到三星给出的证据之一就是强调苹果的
类似创意来自索尼，证据是他们（苹果）当时面试过一个索尼的员工。我不知道三星哪
里得到的如此具体的信息，其实侧面也证明了三星在类似事情（获取甚至盗窃其它公司
商业秘密方面）是非常有投入的，至少是很有SENSE的，所以都知道。其实那个消息至
少有一个简单逻辑：如果索尼没有提出对苹果的诉讼和证据说索尼员工在面试过程中泄
露了索尼的商业机密，那这个证据毫无法律效应。同样的，我相信苹果有更强的怀疑，
