1. 什么是SCA-5法案?
答: 加州SCA-5法案将废除禁止在州立大学入学种族歧视的规定, 帮助在加州公立大学
学生比例较低的族裔, 增加获准入学学生的数目, 以更符合趋近加州实际人口组成的比
例.
2. SCA-5是否会减少亚裔学生入学的人数或比例?
答: 一定会降低亚裔学生入学人数的比例, 因为由于学校预算的限制, 加州大学招收的
学生数量是有限制的, 不可能无限制招收学生, 学校必须在申请者之间做出取舍. 任何
有基本常识的人都应该知道, 在总人数有限的条件下, 如果有申请者因为族裔理由被照
顾, 那一定要牺牲其他族裔的申请者, 这就是俗话说的, 饼就这么大, 每个人都想从饼
上切下一块, 无法皆大欢喜. 亚裔学生属于占加州大学学生比例和数量都最高的族群,
是最主要针对减少对象. 所以SCA-5法案一旦通过, 如果要提高占加州大学学生比例较
低的西语裔和非洲裔, 最主要的改变就是降低招收亚裔学生的数量, 数量减少才有可能

SCA 是 Senate Constitutional Amendment 的缩写。 SCA no. 5 是在加州参议院提出
的加州宪法修正案 5.
1996年，加州通过了著名的209提案，也叫加州民权提案。 该提案修改加州宪法，禁止
州政府在公务员招募，公共服务合同签订，和公共教育中考虑种族，性别，和族群因素
。这个提案让加州成为全美第一个禁止公立大学以种族因素为录取标准之一的州。
SCA 5 是想删除掉209提案中任何提到 “公共教育” 的文字。实质是允许公立大学考
虑种族，性别，族群的因素。
==谁提出SCA 5, 什么目的？==
SCA 5 由 西裔背景的加州 参议员 Ed Hernandez提出。理由是加州大学中少数族裔比
例太少，需要宪法允许公立大学录取时候考虑种族背景，平均受教育的权力。
实质是 1996年，加州通过了209提案，成为全美第一个禁止公立大学以种族因素为录取
标准之一的州。至那以后，加大系统亚裔学生录取率较高。像伯克莱加大和洛杉矶加大

发帖数: 31 | 3 【转载】我感觉这个特别会议挺有用，可以是个突破口，突破到华人以外的圈子。地方
报纸都会报，临近的其他town也会看到，也许会有类似的连锁反应。我觉得可以好好把
握机会，试图在整个地区扩大影响到普通市民。
如何做好？策略很重要。
但我觉得，第一，不要抗议，可以有人在门口安静的散传单，跟市民交流。这是全市市
民正式讨论这个事情的地方，没有议员可抗议，要说应该感谢Cupertino同意把这个放
入议程。
第二，组织好进去参加发表意见的市民，最好各个族裔都有代表，不光是华人。然后最
好还是Cupertino的人多点，毕竟是这个town的事情，如果可以联系到town的实际情况
更好。
第三，可以通知附近几个town的local报纸来采访，争取扩大影响。

在2014年初的加州，一场触及华人核心利益的SCA-5宪法修正草案的危机[1]，不仅把政
治上习惯做沉默羔羊的加州华人推到了风口浪尖，被迫发出自我维权，不甘任人宰割的
怒吼，也让全美华人通过网络和亲朋好友的口口相传，亲眼见识到：
（1）政治永不遥远，随时随地就会发生在眼前身边，对个人小家庭生活带来巨大冲击。
（2）政治并不可怕，每个人都可出钱出力，齐心协力改变一个重大议题的走向和结果
；不关心参与，麻木不仁才真正可怕。
SCA-5 好不容易在华人众志成城的努力下流产了，但SCA-6 肯定会卷土重来。打破加州
的一党专政，让联邦宪法所体现的Checks and Balances的美国立国之精髓不在加州成
为一句空话甚至笑话，是让SCA-X胎死腹中的最有效途径。为实现此目标，我们华人在

10月7日，湾区Bay Voice电台关于最近的AA问卷调查做了一个听众访谈节目。题目是：
华人多数赞成Affirmative Action？
因为不少朋友没有听广播内容，就被这个标题误导，我特别把广播概要给大家写一下，
希望澄清误解。
先一句话总结一下节目内容，虽然问卷调查里面说60%华人支持AA，可是这次听众访谈
，打电话进去的七个听众全部反对AA，而且是强烈反对。
再说节目开始，主持人就陈述自己的观点，觉得AA不应该翻译成”平权法案”，这样太
有误导性，应该称作种族优惠法案更合适。
最近进行的这次调查结果显示，全加州各种族普遍都支持AA。其中特别点出亚裔，包括

华人欢庆新年之际，SCA-5 号提案却给欢乐中的亚裔们浇了一盆冷水：此提案已在1/30
/2014参议院(State Senator)27票赞成，9票 http://legiscan.com/CA/bill/SCA5/2013 下一步即将提到州众议院投票。此提案如果在州众议会（State Assembly）获得通过，将於今年11月公投，决定是否恢复在加大校园中实行所谓的以种族等为标准划界的入学措施。鉴于目前加大（UC）各校亚裔学生比例，远超过加州亚裔人口比例，一旦公投通过，加大亚裔入学人数势必受到排挤。各级亚裔民意代表与民权团体，应尽速表明反对立场，勿使亚裔子弟成为种族歧视的牺牲品。
美国宪法第14修正案明确规定，任何州都不可以立法拒绝对所有公民的平等保护。SCA-
5 是错误并违反美国宪法的，是一个赤裸裸的种族歧视的法案。

加州参议院通过的SCA 5修宪案，将用「平权法」限制华裔在加州公立大学的入学人数
。记者于2月26日下午得到从余胤良办公室通过电话发布的消息，余胤良、刘云平、刘
璿卿三位加州参议员，将改变支持SCA 5修宪案的立场。他们将于明天（周四）召开联
合新闻发布会，终止这个法案。
余胤良办公室发言人表示，他们在这两、三个礼拜听取了很多对SCA 5修宪案的关心和
关注后，决定将共同听取的意见反馈给修宪案发起人－－加州参议员爱德‧赫南
德斯（Ed Hernandez），终止这个法案。

发帖数: 39 | 32 10月7日，湾区Bay Voice电台关于最近的AA问卷调查做了一个听众访谈节目。题目是：
华人多数赞成Affirmative Action？
因为不少朋友没有听广播内容，就被这个标题误导，我特别把广播概要给大家写一下，
希望澄清误解。
先一句话总结一下节目内容，虽然问卷调查里面说60%华人支持AA，可是这次听众访谈
，打电话进去的七个听众全部反对AA，而且是强烈反对。
再说节目开始，主持人就陈述自己的观点，觉得AA不应该翻译成”平权法案”，这样太
有误导性，应该称作种族优惠法案更合适。
最近进行的这次调查结果显示，全加州各种族普遍都支持AA。其中特别点出亚裔，包括
华裔，越南裔，也是如此。亚裔69%支持AA，而华裔则是60%支持。节目里面专门请到了
执行这次调查的UC riverside的教授Karthick Ramakrishnan来现场回答听众提问。
第一个听众：我和我周围认识的人全部强烈反对SCA 5，反对AA。所以我认为这个调查
结果可能是被设计误导出来的，或者说，问卷没有正确反映问题根本。

ranking of the UCs and Cal States. We need to put merit and academic
performance as a priority. Have students study more and obtain good grades
and knowledge, thus ensuring their admission. That way, we would have better
students and a wiser populace, as opposed to those admitted through what
amounts to state-sponsored racial discrimination for a chosen few who spend

至于他所说的：
What these Chinese Americans fail to see is that even though they are 40% in
UC, they are only 5% in the nation and 15% in the state. Minorities! As
they band together to get what they want, they define what narrow political
self interest is.
：这不是事实吗？他就是说华裔虽然是少数民族，但反对 SCA-5 这点上，是和白人站
在一起的，而站在其它少数民族的对立面。而这种姿态，是和亚裔自身利益息息相关的。
其实他抬举华裔了，华裔没那么多人。他说的数字或者楼主搁他嘴里的数字是亚裔的比
例。当然他还说了一点：华裔自己不觉得这是错的。从上面网友的发言来看，他说的对
呀。很多华裔都好像不觉得自己和墨裔或黑人有什么共同的地方。
