我对于药物销售的保护还有些不明白的地方，请大侠指教。
我的理解是保护有两个，一个是专利，特别是compound本身的专利，大概20年吧，还有
一个是product的market exclusivity, 如果是头一次批的就是5年，orphan drug 好像
是7年。那么这两个是叠加的呢，还是哪个长算哪个？比如说，
对于一些老化合物来说，compound本身的专利早就过期了，这种情况我想就是靠market
exclusivity来保护药物销售。如果是个很新的compound, 本身专利20年，整个开发过
程可能10年，批准的那天起，专利还剩下10年，也就是说，market exclusivity那5年
失效的时候，compound本身的专利还有5年，要等到批准上市10年之后，也就是
compound本身专利全部过期的那天，generic才可以开始销售，这种情况innovator药物
销售是靠化合物专利来保护而不是market exclusivity

1989年10月1日前夕，上海市府举办招待酒会，庆祝PRC 建国40周年。来宾中有美
国驻上海总领事。原上海复旦大学校长谢希德，在招待酒会上主动问美国总领事“我们
要作甚麽事，才能解决方励之问题？”。大使立即将谢的举动转告我们。

下面是我女儿在高中三年级（2015-2016学年）选修高中《美国历史大学先修课》（AP
American History）时所写的学期论文（junior thesis）。本地高中学生一般公认高
中文科最具挑战的课程就是《美国历史大学先修课》。我女儿总体上比较爱好理工科课
程，对我这个文科专业的父亲来说，总觉得高中文科的课程也是极有意义的。然而我女
儿是一名多年参加体操俱乐部系统训练（每周要有20多小时的体操训练，还要加上外出
参加比赛的时间）的运动员，因此对选修这门阅读量很大的美国历史大学先修课程颇有
顾虑。我考虑到这门课程的对女儿的阅读，思维和写作都有很大帮助，就极力鼓励她选
修这门课程，并且“保证”如果学期成绩只能获得B也不会有所“责难”。最后女儿“
