买房的时候closimg没有把rebate算进去,现在代理说他税很高,估计要50%,而且正在
被audit。所以要到风声过后再给,而且扣去税只有原来的一半了。求鉴定是不是被忽
悠了。税是不是要考虑进去?还有就是我们怎么把钱要回来?请大家支招。谢谢了。

rebate都是closing的时候就给的。他的税和你何干?要是不给就去small claim court
告,在华人圈里曝光即可。
不过希望还是先协调解决,和气生财。

让他开个1099算cost好了, 这样这部分钱他就免税了
另外税率怎么可能到50%?

我们agent告诉我们,买房的时候的rebate只能用来抵扣closing cost。不能多于
closing cost。

You got bad agent.
Your agent just did not want to give money to you.
Your rebate is not taxable to you and won't cause tax to the agent. He/she
can simply reduce his gross receipts.
No need to give you 1099 since you are the party involved in this
transaction, the rebate just reduce your purchase price or your basis in
this property.
I rebate 1-2% to my buyers depending on their purchase price. Sometimes
lender will set a limit on the credit on your closing statement based on
your amount of loan. If that's the case, I usually will remove the credit
and write a check to the buyer after closing.
In one sentence, what your agent told you is trying not to give you the
rebate or give you the less.

这个叫fufu的real estate agent说话就更不靠谱了。敢狂言会计师的专业,不惜误导
大众。厉害。
Commission 是个人收入,得交所得税,至于是谁交,就要看是谁是最后收益人啦。税
率因人而异,也可能因为你收入低,所以你就免了。

If you are a buyer and you want to pay tax on rebate, that is your own
choice. IRS has ruling, this is not taxable to buyer since this is not
income to the buyer, just reduction to their cost for the purchase. Please
check IRS ruling first.
If you are a broker, you can use this as an excuse by not giving rebate to
the buyer.LZ's agent is using that excuse already.
The rebate the broker gives back to the buyer will be treated as reduction
to your income.
Period!! I am not sure why you think I am 误导大众???

There is no reduction to your income in IRS 1099. report the income in full
or is your choice. being audited or not is your luck.

Gosh!! You really want to pay tax if you are a buyer. Or you really want to
give your buyer a 1099 for rebate if you are an agent. Please check the
definition for the INCOME. This is not considered as Income for the buyer
since they paid the money..
Did you get 1099MICS for any rebate you submitted for a purchase of a
product??? Rebate is not considered income. Check the 1099-misc instruction,
that form is for the payment of Income.

He must be an agent. That's why he got so angry about my post. I think all
the buyers will have different atttitude. They will appreciate the
information that I provided and do further tax research to understand.
LZ's agent claimed that he got audited and cannot give back the rebate
during the audit.
It is really funny for this excuse. IRS is auditing his 2011 or previous
years.The 2012 tax return has not been filed. In no way IRS will audit his
2012 activities. I did not see the reason that agent cannot write the rebate
check now? As CPA, I almost laugh when I saw this creative excuse.
The agent claimed that 要到风声过后再给??????!!!!! Only someone too young
and too naive will believe that. LOL

这种rebate都是口头的,但如果还想吃这口饭的话,一般agent都挺讲信用的.不会拖着不
给的.你再等等看看,如果超过一个月了,就暴光他,让他以后没这口饭吃.

agent rebates to buyer and not gives 1099misc to buyer, then agent will
pick up the income tax. If agent do not want to be taxed for the whole
commission, then agent need to give buyer 1099misc. As to the question
whether buyer need to pay tax or not, I heard different explanations on this
topic from different CPA.

OMG!!!!!!!!!!!!
As I said repeatedly, this is not income to you agent as well as to you
buyer. No 1099 needed.
Please do not use this as excuse to reduce buyers's rebate!!!! You do not
need to give 1099 misc to buyer since this is Not Income.

为什么rebate不在closing时搞定?为什么要take a risk? 如agent拿了commission而
不给1099将来怎样向IRS证明他没拿那一部分commission?在tax还是谨慎为好,不要被
IRS盯上。

这玩意儿咋告阿,都是undertable的. 而且确实是要抵税,当然50% 有些邪乎

这个rebate是很普遍的吗?需要自己和agent要吗?一般是百分之几呀?我们现在也在
买房子,第一次用agent, 不懂呀,谁给我仔细讲讲,多谢了。
