2) I submitted H4 COS on Sept 11.2014
3) Mine last day at Company A is Sept 15.2014
4) Now : I got an offer from company B. And my H4 case is pending
Q: 1) How to file H1B for company B

Because you are not working for “company A” anymore and your H4 is pending
, we cannot file an H1B Transfer as you are not holding your H status to be
eligible for an H1B Transfer. Per the attorney, to prove your H1B status we
would need to show that you are employed, and you are receiving paychecks
from this employer when we submit your case.
To proceed with an H1B for “company B”, here are the following options:
1. To receive an H1B approval for “company B”, your H4 has to be
approved so we can file for a Change of status from an H-4 to that of an H1B.
2. You depart the U.S. and we file an H1B for you while you are
outside the U.S. and you come back once the case is approved, and take up
employment with “company B”.
3. You return to work for the H1B employer – “Company A”, to be
eligible for an H1B Transfer.
