定美國社會國家制度與內涵，是否繼續維持目前中間偏右傾向，還是會帶往中間偏左，
從而長期左傾化美國社會。
聯邦大法官的判決每每影響美國社會制度與思潮，大法官決判結果可以是「美國憲法精
神的維護」，也可以是在白宮與國會對特定社會議題的爭論都束手無策之時，直接反映
同時也決定美國的社會變遷方向。全民直選的總統提名大法官，再經國會同意提名後上
任，這裡已說明行政立法與司法的三權分立，相互制衡的原則。以這次10月開議的大法
