我其实被summon过了无数回。
早年是绿卡， 直接一个电话回掉。 后来是用小孩waive掉了两次。 等自己真有空了，
想去做反而轮不上了。
我早年还去过一次jury的， 那时候也不想做。 跟传说一样的，想着进去直接说I hate
xxx就可以被dismiss了。
结果进去以后根本连什么案子都不知道。 进来一个人连是不是律师都不知道， 给你张
纸让你做几个选择题就一边呆着去了。 根本没有主动表达opinion的机会。
这里老中大多都是道听途说。 jury summon很容易见， 有驾照基本就会收。 一个个收
了俩summon就好像自己做过jury了。 |

only ones who insisted drunk driving was bad. The rest of them are elderly
people who insisted giving the young kid a second chance.
Imagine having a jury made up of most people from this forum, they would

我自己做过Jury,对上庭的程序有一定了解，也知道一般Jury会怎么去做决定。
这个case,可以说只有物证，没有人证。如果说有人证，那只是警察。而很多Jury都不
太相信警察。因此最后完全会dismissed掉。
我觉得警察的报告非常奇怪，他说在路上看到这辆被偷的车，跟踪它到了住家门口。由
于车后面窗户是墨色的，看不到里面是否有人。后来喊话也没发现发现车里有人出来。
之后被告从车库出来。
这段描述非常矛盾，既然警察已经跟踪这辆车，那么驾驶这车的人怎么会在警察眼皮底
下蒸发掉？被告怎么会是从车库出来，而不是从车里出来？
这很明显就是警察在栽赃。 |

about two weeks at court and probably $10k or so (most grand jury hearing
cost less but his case likely more).
grand jurors are not picked by lawyers and he was lucky to have a mostly
white jury.

我的疑惑是，substantially, voluntariness is not an issue here in this case,
since Commonwealth v. Allen provides "When the voluntariness of a defendant'
s statements to private citizens is an issue, the
judge should conduct a voir dire to determine the
voluntariness of the statements.", this case (Waters) happened before Allen,
and Allen is not retroactive, therefore voir dire is not required,
voluntariness is not determined.

Commentators of 'all sides' said they were shocked. However,
the only person pertain the information of the jury, the
alternate juror, said he was shocked back home watching
TV coverage and the national outcry. He said the jury's
sentiment was that Casey was a 'good mom'.
On the TV, commentators are still in shock a day after
the verdict.

我看ABC，Jury不需要考虑动机，武器；他们也不需要考虑
truth 和 legally truth之间的区别。他们的责任就是找到
truth。从那个alternate juror 的发言看，jury真的不认为
Casey 杀了Caylee。Jury从心里不认为她 guilty，而不是
因为无法克服reasonable doubt。
