一再向我强调是82，言外之意就是，不止10迈了，我根本没法说话了
那个court离我这儿开车两个半小时，去一次成本大概100，如果出庭费60的话，
加上一天时间
我怀疑他们的罚款大概在$400左右，我在想，去的话，怎么争取dismiss掉，是强
调当时的车况，还是强调第一次违规，而且数量比较少，请求给dismiss掉呢？
保险要涨六年？我以为是三年，我们州好像说是record保留三年。。。
我们州规定，在外州拿ticket，没有办法不扣分，不能上traffic school去免除
扣分。。。
谁给我支支招怎么才能出庭尽量争取dismiss掉？先是拖着，几个月以后再去上庭

另外，据说有的地方你可以 argue 说他们的测速设备有问题，如果对方没有办法拿出

motion to dismiss. The local rules can be found on the court's website or
you can request a copy from the courthouse.
Since you're a layman, the judge won't pick on your procedual mistakes too

诸位好。去年我遭人在新泽西恶意诉讼，上个星期法庭判决 dismissal with
prejudice。但是没有批准我们的其他两项请求，即诉讼方赔偿本人的律师费，以及本人保留反诉权利。根据新泽西的法律，entire controversy doctrine，我如果反诉，反诉必须归入本案。但是 dismissal with prejudice 则表示本案已结。
现在我还有14天的时间可以反对法庭的决定。请问我还有反对的必要吗？据说律师费一般是不好拿回来的，但是起码我想保留反诉的权利。本人住在纽约，如果我可以在纽约起诉对方，不知道纽约受不受entire controversy doctrine的限制。一种极端的办法就是解雇我的律师，让本案不能继续下去。法官也许会将此案丢回州法院（现在是在联邦法院），这样我就可以重新开始。不知道在目前这种情况下我能够做些什么。

一个朋友，现在有个pending的criminal charge，不过DA说以后case应该会被dismiss
掉。她是F-1身份，暑假想回国，然后把签证renew再回来。有两种可能性：
1，她在国内等到case被dismiss掉了，然后去renew签证。这样就只有个arrest record
，这样renew 签证的话，成功的可能性大吗？
2，在case没有被dismiss掉的情况下去renew签证，这样签过的可能性大吗？

说我打了她10来个巴掌，还有胸前两个拳头（根本没有的事），拍了照（没有任何淤青
或者出血，虽然警察报告中说Arresting officer xxx completed a domestic
violence package complete with photos of the complainant’s injuries），不知
道是否有录音。当时警察问老婆要不要去医院，老婆说不需要，没去。警察进屋啥都没
有问我，直接把我送到city Jail。第二天老婆把我保释出来了。我现在被Charge
Assault – Family Violence – Bodily Injury Only， 属Misdemeanor 中class 最

被开除的中国留学生主要是学术表现差
对于这则新闻，很多媒体都以“8000名中国留学生被开除，八成学术造假”为题进行了报道，但这种说法并不准确。8000名中国留学生被开除，是美国厚仁教育机构估算得出的数据，在其发布的《2015留美中国学生现状白皮书》中，提到了80.55%中国留学生会因学术表现差或学术不诚实而被开除，这就是“八成学术造假”的由来。然而这两者虽然都可以归结为学术问题，但学术表现差和学术不诚实是两码事，且学术不诚实的比例仅为22.98%，占大头的是学术表现差，比例为57.56%。学术表现差主要是指GPA成绩低（本科低于2.0，研究生低于3.0），这和学术造假没有任何关系。

PROP8不好说，但是很可能DISMISS，这样下级法院的判决就有效，就允许加州就合法了
。因为加州政府放弃了辩护，PROP8一方是没有辩护的STANDING的，他们根本就不是所
谓的被告，被告加州政府根本不想ENFORCE PROP8。PROP8一方既不是加州政府的合法代
理，也没有从同性婚姻里面受到直接伤害。很多的法律政府不ENFORCE，除非这样做引
