一个窝囊的人不会因为是律师就不再窝囊。
当年卡扎菲政变后其下属(少校)出面代表利比亚，
而伊朗的庞大律师团则代表伊朗，和米欧石油巨头谈判。
猜猜最后结果如何？
1。伊朗律师团先达成协议，取得大幅度的原油涨价。
伊朗国王巴勒维得到消息后相当高兴和满意。
2。不过几天，利比亚的军人谈判团也和米欧达成协议。
但米欧的石油巨头给利比亚的原油价大大高过给伊朗的。
3。消息传到伊朗国王巴勒维的耳朵，国王转喜为怒，
觉得他的这些留学西方法律学院毕业出来的伊朗律师团，

发帖简单谈了下经历， 很多人发信问我关于逮捕的问提， 在这里给大家说说。
我 孩子在我来后半年来的。 用衣架打的孩子， 隔壁白人报案， 3名警察来后， 发现
孩子手臂上明显的3条衣架痕迹， 2名警察说是文化问题，一名坚持要逮捕我。 没有钱
， 只能找政府提供的免费律师。 THIRD FELONY---就是我的罪名。 前后2次上庭， 最
后案件被DISMISS 了。 很多人有夫妻吵架， 打孩子， 商店无意带东西出来 等被逮捕
。 最后都不可能到我这级罪名的。 当然最关键的是， 最后如何定罪的问题。 我以上
提的这些情况， 哪怕就找免费的律师， 他和法官沟通后， 最后的结果都应该是
DISMISSED 的。 最后交485 的时候应该到当时的DISTRICT COURT 要个文件， 纪录整
个案件的以及结果的。 连同485 一起递交。

刚刚从法院出来，拿到法官签署同意dismiss的文书，又救了一条人命，但是我还是很
悲伤，美国这样的警察实在太多太多了！
我最近接了一个case，为一个被指控虐待儿童的华人嫌疑犯辩护，在长达几个月的时间
内，我们查阅了所有的医疗记录，询问了所有的证人，根本找不到这个嫌疑人被指控的
一点基础！但是为什么控方要用一级虐待罪起诉呢？我们无法理解！我们于是又花了半
个月的时候对所有的证据一再核对，在这个过程中，我们的发现警察在其中充当了一个
极其不光彩的角色！再直接点说，就是警察隐瞒证据导致我当事人被指控！本来这个当
事人的孩子生病了，然后他们很积极的寻求治疗，因为跟一个医生已经不一致被这个医
生陷害。即使如此，prosecutor也绝不会起诉的，因为孩子的pcp不认为父母有问题，
关键是这个警察把孩子pcp的证据证词隐瞒了，还纂改了不少证词，最终导致
prosecutor做出错误起诉的决定！！！

了，也不怕，因为罚单不是给你的，是给那辆错牌号的；就算上庭而且法官不直接
dismiss(99.9%会直接dismiss),既然那么大的牌照都能抄错，cop怎么证明他vin就没抄

上个月上的庭，直到今天才有机会上来报告一下。
我请了律师陪我上庭。最后case dismiss，交的100刀保金退90. 10刀算手续费？上庭
总共不到半个小时。我和律师约好上庭时间提前半小时见面，我将我的原驾照所在州的
驾照reinstate证明以及刚考的驾照还有车灯修好的照片交给律师。进入法庭后里面有
好多人，大家都去报到。有律师的，律师去报到。法官出来前律师和检察官（很年轻的
MM）讨论了一会儿，给她看了证据，稍后向我使眼色，我明白case dismiss了。然后法
官出来后挨个叫名字，我是第二个，听到名字后我和律师一起走到前台，法官和检察官
说了句什么然后说case dismiss。我的律师紧接着要求refund 保释金，法官说会退$90
.我说了句"Thank you"就走人了。

rules. If the court tries to reschedule it, you can try to talk to the
judge say you'll be out of the country and won't be able to attend. You
have a change of getting it dismissed then.
2. No, you'll get 污点. The only way to avoid 污点 is case dismissed, or
attend traffic school which will hide the ticket for 2 years.
Also, pay extra attention to your 2nd ticket. If you are found guilty,
your 1st ticket may appear on your drive |

发帖数: 1 | 40 碰上警察拦路检查。我开车，bf坐副驾驶，我当时是拿permit（现在已经考了驾照），
bf有几年驾龄。警察问了很多证件，一一出示。等问到车的保险时，我们才发现放在车
上的保险卡都是过期的，三月份renew过的保险卡忘记打印出来放在车上。
警察就开了一张ticket给我（车是bf的，但警察说我是司机所以我吃ticket），原因是
‘operating uninsured vehicle'，金额为’individual bond (full) amount $2000'
.当时警察说上庭带上保险信息就可以dismiss。
从来没上过庭，也是第一张ticket，现在想请教一下大家：
1.上庭时，在法官来之前是不是可以拿保险卡给警察看一下，然后恳求他dismiss掉
ticket? 或者把保险给aternal看，然后恳求dismiss ticket？
2.如果1不行，在庭上被法官问是不是guilty的时候，应该回答是还是不是。
3. 要带的文件当中，除了现有的保险卡，还需要带什么其他的文件吗？有些什么注意
事项吗？

如果ticket上的牌照不是您的,为啥不直接告诉judge 这 ticket应该被dismiss? 为啥
file motion to set-aside default order? 是不是应该file motion to dismiss？难
道过了三个月抗辩期就不能file motion to dismiss?

if they paced you, they have to have produce a certified calibration of the
car speedo done within 6 months, if they dont have it then you walk because
their speed measureing device has not been proven within a legal degree of
certainty as accurate..as LONG AS YOU know to ASK FOR IT.

记录，我给你一个deal, (哪怕这个人过去每年都获得至少一张ticket)
你这些理由都可以说给judge，不过你十有八九见不到他，如我前面所述。
你这些情况都可以说给magistrate，不过他十有八九不会采纳，如我前面所述。
你这些理由最大的用处是和条子讨论，问他如何做，一直问，如那个法律，他如何判断
，。。。他十有八九失去耐心，你就胜利在望了
你这些理由可以和chief deputy, law department 讨论，拿他们的话做为你defense
的依据
Argue的目的你自己最清楚，我说了，如果有时间，一定不能放过丫的。 给ticket的条
子大多是没有职业道德的。他们配合政府抢钱而已。十有八九具有种族。。。
1.啥也不说，也不用去，交钱，点不减，（这个你十有八九不会做的）
2.去pre-hearing, 见magistrate/assistant, guilty with explanation,十有八九
告诉你减点，多交钱.你不能改口说no guilty.

我原来开的车已经彻底毁了，估计知道我这两次事故的除了我老公以外都没人敢坐副驾
驶座来指导我开车了
court的人会让你交钱然后90天后，再查一下你有没有再犯。没有就dismiss了。 说起 |

我早上8:00左右，在local路上，朝东面开车，太长非常强、刺眼，我没带墨镜，什么
都看不见。就不小心开到curb上面去了，还撞倒了一个路牌。警察过来给了ticket。
我觉得主要是阳光的问题，有没有可能上庭ticket被dismiss掉。
我咨询了律师，他们收费$500，说是可以改成其他轻一点的ticket。
大家有什么建议?是我自己上庭争取dismiss呢?还会请律师？如果自己上庭，没有
dismiss成，会扣4 points的。 |

其中一个"ticket",是驾照（刚刚换的新的）和registration地址不符。他让我改了地
址，然后去DMV可以dismiss这个ticket
请问这个怎么操作？我先在DMV网站自己改了regstration地址，然后打印出来，亲自去
DMV office 要求dismiss? 可以不亲自去，打电话dismiss么？完全没idea。。。

昨天开车按GPS去一个完全陌生的地方，一个sb警车本来在我前面，后来不知道这sb怎
么看我不顺眼了，就故意停在路边一小下，等我开过去，就马上从后来跟上我，一直在
我后面跟着我开，本来路就不熟，GPS显示得也很confusing,他又这么故意绕到我后面
follow着我，一个sign没看清，我就开错方向了，开到了one way,称逆行了。这个sb警
察在第一秒种响了警号！
警察要是这样故意绕到别人后面故意follow别人开车，我觉得是故意的骚扰和distract
