这么说吧,根据我的出庭经验,90%的case都会dismiss掉. 所以,一定要出庭!!
为什么会dismiss???
(1) 警察开的罚单成千上万,要是一个个排开来审,法官再增加十个也不够用,24小时开
庭也审不完..所以,一般都要dismiss掉. (当然,这是我的理解和猜测哦).
(2)既然审不了那么多case,为什么还要开那么多票? (A)你的确违章了.(B)为地方增收.

去年8月25号晚上,从家里去学校的路上被抓,40的路,条子说我开了54.二话不说,一张
ticket,我一看,还是我们学校的警察,nnd,下手真狠.条子是迎面开来的
然后就去法院要求上庭,初定是11月底吧,一共要去两次,前一次递交motion,第二次
trial
谁知道我把日子记错了,递交motion那次忘记去了.第二天再去,说只能重新安排时间.于
是motion递交排到1月27号,今天trial.我对本州的speedy trial不是狠了解.由于上一
次也是我的失误,没能按原有排期,所以我也不指望靠speedy trial的trick了.
1月27号,坐在大厅里面溜溜的等了几个小时,无聊透顶,自己翻看着打官司的书.老爸非
要陪着去看看,也是无聊的坐了半天.倒是前台坐着的一个貌似intern的小姑娘clerk,她

4月出的剐蹭事故，双方车都有部分损伤。警察给两人ticket。6月上庭是对方没来但警
察来了，法官dismiss我的ticket。刚过两天收到对方保险公司来信，说他们在调查事
故并评估损失，还让我提供车辆受损情况的照片。
我给他们发邮件说法官dismiss我的ticket，你们打算怎么赔。没想到他给我回邮件说
他们判断责任在我，要我赔偿一切车辆损失或人员受伤，不陪就吊销我的驾照。
他们说法官dismiss我的ticket只是关于交通事故，不是判定谁的责任。最后说他们回
给我书面的拒赔通知。
小弟第一次出事故，出庭时法官dismiss ticket也算万幸，但对保险公司的事不太了解
，还望XDJM们指教，在此感谢！ |

刚从法庭回来，是关于超速罚款的事情。其实金额也不大，就200刀出头。主要是那个
警察冤枉我了，超速的是另外一辆车。我想上法庭和法官讲讲，真是判我输了，就交钱
了。而且这张罚单是去年4月开的，那警察都申请了很多次延期，按规定双方只能个有
一次申请延期的机会。反正这是我第四次请假去法庭了。就是想开开眼，看看美国司法

庭讯后，竟然来了一个不是给我开罚单的一个警察，并且他发誓是他给我开的罚单。我

，他去年掉了很多头发，体重降了45磅，所以外貌不太一样了。笑话，给我开罚单的是
一个20多岁的年轻人，高高帅帅的，一头密密的棕色头发。这位是个40多岁秃顶警察，
就剩几根黄色发红的毛，外貌完全不一样，就不是一个人。妈的，光天化日下说谎。其

我之前吃其他ticket的时候问过，人直接拿出一张单子，说了什么类型的ticket罚多少
驾照分，罚多少保险分，涨百分之几的保险。
如果你不去出庭，直接交钱，就表示你认罪了，那么该罚多少分就是多少分。
问题是如果你出庭，一切就都有的商量了，我一个哥们儿第一次超速，出庭，和
District Attorney墨迹墨迹，最后按超速5 mi算，不留任何记录，不影响保险。
另一种商量的结果是PJC，几年内不吃新ticket就不加保险。如果拿到PJC，当下只需交
出庭费，不需要交罚金。PJC自己出庭就可能搞到。
你也可以找律师，第一次吃ticket搞不好可以直接dismiss掉。如果成功拿到dismissal
，出庭费和罚金都不用交，只交律师费，当下也不亏，长期的话省了保险钱和不良记录
。当然，律师不可能保证拿到dismissal，这个你要自己和律师聊一聊，看看可能性。
Dismissal不请律师不大可能自己拿到。
针对超速，据说可以声称自己的速度表有问题。据说这算是“潜规则”，双方心照不宣
，法官会放你一马。这个理由只能用一次。我忘了自己就能搞定还是要请律师了，你再

不过这个貌似太过复杂了额...看不懂
我的情况是 今天被警车拦下,说超速,local限速35,说我开了47,48.
我估计是45左右,因为看见有个绿灯在前面,也没什么车,想多一脚油门,可能就是那短短的十几米就
被警察抓住了.
不过运气不好,刚好保险3天前到期,新保险在路上,车上暂时没保险的paper.
过了一会回来了,还是那老样子,1. 你35开48, 是220美金的罚单 2. registration
card 上的地址和驾照的地址不一样 3. 车上没保险的paperwork,也是多少多少钱.
但是 (终于等到这一句) 我给你很好的break, 你只用掏95美金就好了. 可以上庭申诉
,也可以付款.
解释下,第二条registration card 的地址我确实没注意到, 我以为去了DMV更换了新驾
照地址,所有系统内的信息都会更改的,但是没想到registration要换新的了.

今年我老婆吃了张罚单,我更是信心百倍要去跟他们理论理论.到那里溜溜等了三个小时
,还不叫我们,都快没有人了.我老婆上去问怎么回事? 人家一查,说一大早开门就宣布了

我就说了个ford最近几年投诉有点高是有一方面原因是my ford touch投诉多贡献不小
就被咬住不放，对了我原来的说法是微软的烂系统
非要我解释这解释那的，要证据，要数据，要……直接给我扣一帽子，什么误导别人
误导你妹啊，就算我真的说的不对，误导又从何而来？何况我说的完全都是事实
我擦，罔顾丰田自动加速投诉是别家好几倍，什么自动加速换空档就好了这些不算误导
？

发帖数: 18 | 39 前一阵在Irvine一个路口，黄灯红灯之间一着急冲了过去，结果被拍照。最近收到闯红
灯ticket。有人建议说可以找律师处理，dismiss这个ticket. 我联系了律师行: law
office of Scott，他说可以代表我出庭，争取dismiss这个ticket。有两种收费，一种
普通收费不保证dismiss，只是说很高chance，一种高一些收费，说如果不能dismiss，
也由他们公司付ticket.
我想知道这种律师靠谱吗？？大家有没有找过类似律师？求经验。。。谢谢！
另外提醒大家Irvine Dyer Rd近55号路口有拍照。。。 |

dismissed case should not effect the GC.
我知道好几个人被不是因为traffic警察抓过，到过jail, 留了指纹,后来case
dismissed， 绿卡照拿， 一点问题都没有。
关键是要plead not guilty, and finally dismiss the case。

。像我这种情况要是申请上庭的话，应该填认罪呢还是无罪辩护呢。没有经验呀，请大

补充一下：因为要转去的车道有三条lane, 我转到里面那条lane之后很快换lane了，后面的车本来就在中间那条lane上，所以在我换lane的时候撞到一起了，警察说是不安全换道，所以是我的责任。我想问问大家我应该在罚单上填认罪请求减免呢还是无罪辩护呢。

员，工作人员简单介绍了一下处理ticket程序，今天其实算“庭外和解”，如果谈不拢
deal，再约一天时间然后真正意义上的上庭，到时会通知警察出面提供证据。因为
registration 或者 license (没带，过期）的情况连谈都不谈，直接dismiss掉。工作
人员还提供一些以前别人常用的理由，说那些理由都可以用的。然后一个接着一个到办
公室关起门来解释谈deal。轮到我时，我辩解说我在红灯前停了，只是停了很短的时间
就右转了，我还简单画了图说我当时丁字路口红灯右转论理讲不会有安全隐患，结果工
作人员说不用解释太多，他懂的，以后红灯多停一会儿，说后面还有很多人排队，然后
就dismiss了。几十个人，每人两三分钟，估计每张ticket都被dismiss掉。 |

DISMISS这个案子。美国的法律非常复杂，我估计这里的扇子大多不是法律专业，也没
时间或兴趣仔细研究长达几十页的诉状，所以我把一些基本情况用简单的语言陈述一下：
（1）原告是宾州，不是PSU
（2）告NCAA的一个基本出发点是他们违反了反垄断法中的相关规定，具体条款就不引
用了
（3）受理法庭是UNITED STATES DISTRICT COURT,MIDDLE DISTRICT OF PA
（4）目前处理此案的法官是名女性，JUDGE KANE
（5）昨天第一次HEARING，注意：不是审案子，没有WITNESS等，只有双方律师陈述。
唯一目的是判断NCAA要求DISMISS这个案子是否成立
（6）HEARING完了后，主审法官表示她将在A COUPLE OF WEEKS里作出决定，即是否继
续推进此案
以上是基本情况，分析如下：
（1）是否决定继续推进此案是一个关键环节。如此案继续推进，则将进入所谓的

片白平衡的教程很有用，专治各种白平衡漂移。以前在水族馆拍的照片，因为室内照明
的问题，照片都是蓝蓝的一片，调一下白平衡，所有的色彩就恢复了。
注：照片里最好有白色的东西做参照物，比如衣服，饰物，即使是很少的一点点。

这么说吧,根据我的出庭经验,90%的case都会dismiss掉. 所以,一定要出庭!!
为什么会dismiss???
(1) 警察开的罚单成千上万,要是一个个排开来审,法官再增加十个也不够用,24小时开
庭也审不完..所以,一般都要dismiss掉. (当然,这是我的理解和猜测哦).
(2)既然审不了那么多case,为什么还要开那么多票? (A)你的确违章了.(B)为地方增收.
胆小怕事的,嫌麻烦的,兜里不缺钱的,直接就交罚款完事,给地方财政作贡献了. 既然你
要不怕麻烦排除万难去出庭,他倒嫌麻烦了.
(3) 警察没来. 要是警察都能来,路上大概就看不见警察了....

我们州规定，只要在外州拿的ticket，内容在本州应该扣分的，
外州把信息传到我们州，就一定会扣分，不允许上traffic school抵
我这个超15迈以内的，我们州扣3分
所以现在除非外州把我的ticket给dismiss掉，扣分，涨保险费是肯定的
还有就是罚款，我怀疑他们的罚款额，这个超速数量，在$400左右
上庭成本是$100左右吧
现在就4个可能了：
1）不上庭，扣3分，直接交$400罚款，加上3年保险费涨价，就算$400，一共是$
800
2) 上庭，dismiss掉，上庭成本$100
3）上庭，不给dismiss掉，扣3分，减免一点罚款，就算减到$200，上庭成本$10
0，加上3年保险费涨价，就算$400，一共是$700
4）上庭，维持ticket，扣3分，交$400罚款，上庭成本$100，加上3年保险费涨价
，就算$400，一共$900
看起来应该去上庭争取减免一点罚款，甚至dismiss掉？
plea not guilty？
还是直接plea guilty，请求减免罚款？
还是先plea not guilty,不行再请求减免罚款 |
