只好自己赔了 或者赶紧刷爆所有的卡 退学回国
事情是这样的：圣诞节的时候和朋友一起去加州玩，租了一辆车，当时我租车时没有买
租车公司提供的collision，只买了liability, 但是随后在高速公路上追尾，出了事故
，还好人无大碍。经过漫长的等待以及与警方、保险公司、租车公司相互扯皮之后，现
在租车公司让我赔，所有的费用一起要7700多美元。
由于是出去玩，我没开自己的车，就是到了目的地租车。我自己的车保没有collision
这一项，所以他们也拒绝提供支付修车费用；
我以为用信用卡支付租车费用可以利用大多数信用卡公司推车的“事故无责任”保险，
结果不巧在priceline预订车用的是VISA， 而被租车公司扣除的其他费用（包括
liability insurance，机场费，加油费，异地取车费等）是划到了MasterCard上。
MasterCard认为主要的租车费用用VISA支付了，而后期费用不是租车费用拒绝赔偿；
VISA 认为在整个租车周期内（12.23-12.31)凡是跟保险公司发生的支付必须用同一张

损失的；只给赔别人的，不管你的损失的。collision保险就是只给赔你的损失的，无
论责任。
如果是对方的责任，应该找对方的liability保险。如果你找你的collision保险（如果
你有的话），那就和你自己责任一样；会要出deductible。
如果是你的责任，而且你是全保（就是有collision保险），找你的collision保险。

看来丰田仓皇上架的所谓自动廉价防撞系统又是一个忽悠人的破烂，是真cheap到家了
和丰田编造的可靠性都是莫须有的忽悠人的摆设
很奇怪iihs怎么打分的，速度虽然降低了但是最后还是撞了也能得这么多分，既然aeb
是用来防撞的，撞了当然应该0分

撞是两个弹性小球的碰撞。碰撞涉及弹性形变，因而碰撞过程从碰撞开始到球拍和球分

if you hit something and damaged your own car, collision covers that.
you need to pay deductible for collison and comprehensive
are you sure on the comprehensive and non deductible part? usually
comprehensive goes with collision. if you don't buy collision, you can't
buy comprehensive. maybe you can... but it's not common

1. liability是不是不管谁的责任，都帮忙赔对方?但是如果低于financial resp.中最
小的coverage，那么怎么赔的？
2.uninsured motorist，和underinsured，这里区分责任在谁么？
3.个人身体伤害，会有health insurance负责么？这里的Body岂不是重复了？
4.假如发生车祸，如果责任不在本人，a责任谁来判定？b如果都没有liability和
collision，那么谁来赔付？ 就私了，完全没有其他法律约束了么？

我买的是Geico保险。
If you select Uninsured Motorists property damage, this coverage must be
carried on all vehicles without Collision coverage. Vehicles may not carry
Uninsured Motorists Property Damage and Collision coverage together to avoid

deductible和collision deductible是不一样的。所以，要claim之前，先问清楚自己
的agent这两个deductible分别是多少。你做claim不是在agent那里做，而是打保险公
司的claim电话anyway,所以给自己的agent去个电话，对你没什么害处。
comprehensive or not, 你应该知道你是有不同的deductible的。collision
deductible可能有500，non-collision可能只有50的deductible, 而uninsured
motorist可能是250的deductible。买的时候大多数的人稀里糊涂，用的时候再不弄明
白点，那岂不是要糊涂一辈子？ |

车是一辆2013款Fouse新车，6个月$1912， 如果4，5项升到$1000免赔的话，保费是$
1651。
我问除了前三项，其它项全部去除的话，保费是$590左右.
我是新手开车，开车应该比较小心。自己的车也不值钱，蹭了就蹭了。
大家觉得是不是只买前三项就好了。
另外一个问题是，如果自己的责任，开车撞墙或撞车，如果有我自己车内人员伤亡，前
三项保险是不是可以赔？我自己的车就算了，肯定不包括了。人包括吗？

下面是progressive的解释，其它保险公司基本都一样。这种车的碰撞除了collision，
或许可以用Uninsured Motorist Property Coverage来赔付，但是估计lz朋友也是没有
购买，买了也未必可以argue到。

when you collide with another vehicle or object. If you hit a car, a pole

only but I do not know of any that would sell comprehensive to you without
collision coverage...
fyi (in case someone else wants to know):
collision kicks in only if the damage to your car is due to collision (an
accident...) whereas comprehensive covers any damage to your car such as a

「菲律宾对中国」南海仲裁案，常设仲裁法院今天公布结果，称中国大陆在9段线范围内主张的历史权利没有法律依据，而南沙群岛的所有海上地物，均为礁岩，包括太平岛在内。
马英九晚间在脸书发文表示，从去年12月到今年5月，包括他在内，150多名部会首长、国内外学者专家和国内外媒体，都访问太平岛，亲眼见证这个淡水充裕（南沙唯一）、农产丰富、生活机能完整的岛屿，完全符合「联合国海洋法公约」第121条关于「岛屿」必须「维持人类生存与自身经济生活」的要件。
他说，至今年4月底为止，也有430篇国际媒体完整陈述「太平岛是岛」的事实。太平岛是「岛」不是「礁」，已是国内外多数人的共识。

今日，根据《联合国海洋法公约》(“《公约》”)附件七组成的仲裁庭就菲律宾共和国
对中华人民共和国提起的仲裁案作出了一致裁决。
该仲裁案涉及在南海的历史性权利的作用和海洋权利的渊源、某些岛礁的地位及其能够
产生的海洋权利，以及菲律宾声称违反了《公约》的中国某些行为的合法性问题。考虑
到《公约》对强制争端解决的限制性规定，仲裁庭强调，它既不对任何涉及陆地领土主
权的问题进行裁决，也不划定当事双方之间的任何边界。
中国反复申明“其不接受、不参与由菲律宾单方面提起的仲裁”。然而，《公约》附件
七规定，“争端一方缺席或不对案件进行辩护，应不妨碍程序的进行”。附件七同时规
定，在争端一方不参与程序的情况下，仲裁庭“必须不但查明对该争端确有管辖权，而

天数等等，自己保险保费还会涨。买租车公司的保险，什么费用都包了。
自己没有全保的话，租车时使用的信用卡一般会cover $50,000 collision险，有Amex
卡可以买他们$29的collision险。不过建议最好还是买租车公司的collision险。
人身伤害险自己车的保险自动cover你租的车。
如果其他人要开你租的车的话，最好把他们的名字加到租车合同里，否则买的保险是不
保的。

因为第一次碰到这种事情，一开始有点心慌。 我们保险公司不同意对方的结论，准备
inter-company arbitration。
collision是在MA， 对方的claim adjuster在PA，对方完全忽视MA laws
Standard of fault Rule （有兴趣的朋友可以看看下面的连接)，尽纠缠who hit who
。这些standard of fault 其实和who hit who 根本不相关的，比如左转的车，只要和
对面的车collision 就是左转车的责任，而且MA是只要at fault more than 50% 就等
于全责。
