，整个过程只用了两周的时间！欣喜之余来版上汇报一下，给后来人以参考。整个申请
过程有些具体问题也咨询过板上牛人，得益良多，在此把所用材料大致情况分享一下。
DIY的材料基本全部参考板上精华区的NIW模板，只是针对个人研究部分加以修改。所以
对我的情况，版上的模板应该足够了。推荐信一共找了4封，两封来自前老板和现在同
事，两封indepedent，数量不是很多，但基本上cover了主要研究内容。文章和review
数目还可以，citation很糟糕（20来个），所以没有刻意突出citation的问题。装订上
完全参照版上前人经验，只是将Petition Letter及支持材料与140表格等分开装订，使
用的tab只是将主要category标明而已，文字用ink笔手写。
最后文末附上所用cover letter，其他具体材料参考精华区足矣。
PS:问一下现在做什么？是不是就是等485排期了？

材料/化学/电子方向，国内博士，博后2.5年，现美国20-30名大学博后。
40篇文章，一作10篇，全部英文，IF从2-40左右。一作IF>10的大概6篇左右，合作论文
中有2篇Nature子刊。论文大部分发表在Top 0.1-Top 1%的期刊上(based on total
citations)。在PL中99%的地方在讲第一作者的工作。我觉得讲合作的论文也是可以的
，但懒得去挖掘合作论文中的亮点了。好在第一作者的论文也有很多亮点。
引用：大概2000次左右。合作的论文中有几篇hot topic的文章，单篇引用好几个都在
300+。自己一作文章被引大概300次左右，有一篇100+。一作文章中有一篇被大牛写了
专门的2页highlight评价为“重大进展、重要突破、奇迹、这个领域革命性的成果。。

审稿：10几个杂志，110篇左右。杂志IF从很低到15不等，有不少杂志排名在Top 0.3%,

昨天老婆也绿了，我们情况比较特别不能同时主副申请
她的比较特别，希望对同样情况的人有所帮助
来介绍她的情况

6月补RFE后就没消息
中间做了３次SR和一次infopass，得到的答案就是继续等待
后来发现485上receipt notice的preference classification是2nd
她有ＮＩＷ和ＥＢ－１ｂ
我们一直认为移民局搞错了employment based将她归于第二类(NIW)而不是第一类(Eb1b)
移民局不承认错误，也让她有耐心继续等
后来找了ombudsman发现移民局确实搞错了
再等了350天，她终于绿了！！
如果你也是同时有ＮＩＷ和ＥＢ－１，先查４８５上preference classification是否
为第二类．如果也是第二类，直接找ombudsman来加压移民局改正错误

过去30天看见好多EB1B的战友被0002和0214 NOID，我也预感不好，今天公司律师告诉
我收到NOID(其实已经过去好几天了），算了下只有20天出头的时间准备材料。
申请的背景如下：
1. PhD，业内大公司R&D Engineer，分析化学背景，偏冷的仪器领域。
2. 一共7篇journal，其中5篇一作。3篇1作和另外2篇不是一作发表在Analytical
Chemistry上（领域top期刊）。
3. 推荐信7封，一封来自导师，一封合作教授，一封公司研发部VP，其他4封是
independent，分别来自美国，英国（2封），瑞典。
4. 提交的时候引用77个，现在89个。
5. 会议oral presentation 4次，poster 1次。
申请的情况：
公司一直用Fragomen的律师，申请过程中感觉水平不行，我自己早期把关了RL（现在看
来是没写好没突出重点）和后期自己按版上的完全重写了PL（自己感觉写的还可以，感
觉IO没看）。
律师的PL claim了4项，只有7页。我后来删减到了3项，扩孔到15页，涵盖很多大家常
用的方式。

刚收到律师的信说他收到了NOID。
我们单位是美国去年第一的医院，只给senior的researcher办EB1B. 律师说这还是第一
次收到NOID，说“ we have never gotten a response like this from a case like

我看过后不太理解大概意思是被ref的内容是contribution(具体内容见如下图片，还在

大家好，
想问一下我的EB1-B 140被拒了以后应该怎么办。
我的个人情况如下：美工程专业博士毕业5年，在美一家国家实验室工作。10篇论文，
其中两篇第一作者（最高影响因子6左右，平均发文影响因子1～2），citation数在100
左右，review大概20篇（最高影响因子5左右，平均review影响因子2），14封推荐信，
包括两封来自journal editor的。今年5月实验室帮助申请140，PP。7月得知最终被拒。
在Intent Decline letter 写明了我的论文和review两项是被认可的。但是在第二步最
终材料审核（6项中2项满足情况下综合判断）时候我被认可的两项被推翻了，其中理由
真的看不懂。
在这过程中我有一些硬伤：1）publication第一作者不多；2）推荐信没有independent
推荐人，多数推荐是都是认识的。而且推荐信在准备过程中其中指明我是outstanding
，top 2%这样的词汇太少了。3)citation量少了些，但是估计短期很难马上上去了。

specially the classification on your card is incorrect"。 要我把卡寄回去。
当然也只有照做了。但不知道大家有没有碰到类似的情况？还有那个"classification"

发帖数: 3027 | 45 很多律师是错的,最好自己仔细研究一下移民局的官方文件,然后不断地追问他们.如果律师坚持自己的意见,追问他们的移民局的官方出处.
我问过自己的律师,说没有问题,除非移民局主动取消你的,因为诈骗原因.unless the previously approved Form I-140 petition has been revoked because of fraud or willful misrepresentation. 我的第二个律师回答基本上很正确,我的案子没有出一点错.及使这样,有时也会告诉错误的信息(比如DOL有PERM processing time tracking link, 但被告知没有).及时这样,我还是自己验证了很多,都是用USCIS网站上的pdf文件. 或者AFM.
仅供参考,个人认为"另外，如果老公司revoke旧的140，就不能carry over优先日期。"是错的.原来的公司怎么证明自己是"fraud or willful misrepresentation"?除非是以后不想为员工办绿卡了.

There is no clear definition of what constitute "same or similar," but a
USCIS adjudicator will consider the following factors:

发帖数: 4704 | 47 我的想法是不要超过2点，否则多而乱，结果一场热闹，别人什么也没有听进去。
所以我觉得，只要能够精炼到以下2点，哪怕任何一点成功了就是胜利。
（1） I-140 portable （不用再说PERM portable了，为什么呢？ PERM和I-140是在一
起的，办了PERM的人肯定会办 I-140, 一件事何必分成两见事说呢？）
（2） H-1B 失去工作有至少六个月周转：卖房，找新工作，安排小孩学校等等

既然最近能够递交的人其实很少，那么USCIS所处理的大多数应该是大潮之前递交的。
每个月的变化不就差不多是USCIS处理的申请案件数目了吗？
当然，有一些没有赶上大潮的最近补交了，有些EB3改EB2了。但是都是少数吧。
