U.S. Supreme Court nominee Neil Gorsuch drew fire in his Senate confirmation
hearing after the high court Wednesday unanimously rejected his position on
the educational rights of disabled students.
The Supreme Court ruling, issued in the case of an autistic boy, said school
districts had to do more to meet the needs of disabled students than
Gorsuch had required in a 2008 appeals court ruling. Gorsuch had said the
school districts "merely" had to provide more than a minimal amount of extra
help.
"We have to look at your words and try to look into you heart with these
words," Democratic Senator Dick Durbin of Illinois said. "And when I look at
that word ‘merely,’ it troubles me."
Chief Justice John Roberts’s opinion for the Supreme Court said the proper
standard under a federal law that protects disabled students was "markedly
more demanding" than the test the appeals court had used. |
