as per a recent blog post by USCIS on Aug 3rd 2012, they clarified that as a
startup founder you can apply for your own H1b if you have a board which
controls your hiring, firing and compensation.
Your idea that if you get selected at YC, get a friend - whose name can be
on the company and you own all of the class A stock. the structure of the
company is immaterial to the Gov and have a VC on the Board.
Another idea would be, you form a company for the intellectual property of
your product. have that in your name. Keep it as an LLC. have another
company to run the financials, which will also take care of your H1b. since
USCIS only cares about 1) if the sponsering company can afford to pay you
for 2 years.
2) if its legal. and doesnt care about what sort of IP its sitting on.
I chose the second option. so far so good. i still dont have revenues so i
