Contrary to some early predictions, the Supreme Court didn’t issue any
rulings today on the two cases affecting gay marriage. This was a scheduled
day for the Supremes to make some rulings, but they stuck to minor cases
about Miranda rights, driving records, generic drugs and a challenge to the
Voting Rights Act.
Decisions typically come on Monday and Thursdays, so we could get a verdict
on either or both marriage-equality cases in a few days. But knowing what
drama queens the Nine are, we’re guessing they’re gonna hold out to the
very end of the June deadline and issue rulings on the Proposition 8 and
DOMA challenges on June 26 or 27. (If the Supreme Court was more fabulous,
we’d say it was because they wanted to give us a Pride weekend gift. But
they’re not, so we’re not gonna say it.) |

of June (that is, June 27), just like 10 years ago, the ruling of Lawrence v
Texas.

太乐观。

Prop 8 的判决倒是有很多种可能, 但broad ruling的可能几乎为零. 庭辩之后学习了
不少评论, 我觉得最大的可能是以上诉方缺乏standing为由dismiss. 这样, 下级法院
的判决依然有效, Prop 8被推翻, 但只限于加州.
呵呵, 我今天又大嘴巴了.

发帖数: 312 | 31 DOMA的ruling是基于宪法中平等保护的原则, 而不是基于state right, 所以是一个
broad ruling, 这是重大利好.
因为如果以state rights为法律基础, 那以后就很难要求联邦法院废除像阿拉巴马州的
宪法修正案. 但现在是以第五修正案的equal liberty原则为法律基础, 这就为将来的
诉讼提供了先例和法律依据. |
