合同写的不一定合法。建议你咨询一下律师或者city有关部门。美国多数地方法律倾向
于保护租客。如果租客找了人来sublease,而房东拒绝的话,造成的损失很可能需要房
东承担,无论合同是怎么写的。
按照good faith的原则,房东和房东都有责任避免空置。举个例子,假设是在加州。
租客在合同未到期的时候提前搬走了,然后房东就有义务去找新租客。当然如果尽力了
而找不到,那损失有租客承担,但如果不尽力找,或者租客推荐了合适的信租客而房东
拒绝,那损失几乎一定是由房东承担 ----无论合同怎么写。
我有一个建议,不一定最好,但你可以参考一下。
1)找人来sublease,然后对方表示愿意接手房子的意愿(可以用email证明)
2)找房东商量,获得房东拒绝你sublease的书面证据,也可以用email之类的。
3)去小额法庭,起诉房东
我相信你很可能会赢。

In California, Civil Code 1951.2

Under Civil Code 1951.2, the tenant owes the remainder of the rent due,
minus what the landlord should have avoided losing by re-renting the unit to
another tenant. The unit must be advertised at the prevailing rent and all
applications must be forwarded to the landlord for consideration. If one of
them is accepted then, the departing tenant merely pays any lost rent from
the time he moves out to the time the new renter moves in. The unit should
be cleaned and the landlord should perform a final walk-out inspection
before the new tenant moves in, in order to have the security deposit
returned. In the event that the landlord refuses to accept any of the
forwarded applications, however, and fails to perform an exit inspection,
the departing tenant can sue him for failing to have done his part in
mitigating his losses. If the security deposit isn’t returned within 21
days of vacating the premises, the tenant can sue the landlord in small
claims court under Civil Code 1950.5(f) for triple the amount of the
security deposit. |

自然倾向于保护房东,而多数地方的法律是倾向于保护房客的。

还据了,那就是房东的问题了。
