下麵是我網上找到關於 Will 和 Trust。唯一的區別是 Will 需要 經過法庭?
A Last Will is used to distribute property to beneficiaries, specify last
wishes, and name guardians for minor children. It is an important part of
any estate plan. Without one, the courts will make these critical
decisions for you.
A Living Trust is used to transfer property to beneficiaries. But unlike a
last will, a living trust is not usually subject to probate court, which
can take years and cost thousands in court fees.

will是你的will，啥都能管，比如你的孩子归谁养。trust只能
是钱物。
这是最大的区别。很多人把钱财都放到trust里，will就是谁养孩子。
trust里的钱，因为理论上不是你的财产了，所有没有probate。
其它的，不管will里是不是mention，超过限度了就要probate。
但如果有trust，will里应该提所有财产都进trust。这样还是不用
probate。 |

钱多的人复杂。钱少的很简单，自己弄一个trust和will就行了，
可以不花钱。

发帖数: 246 | 7 这个问题，其实比较复杂，最好请专门的律师咨询一下。根据你的财政情况和自己的岁
数，看是wills 还是living trust比较适合你。
上面有人说得对，inter vivos trust一个很大好处是避免今后财产需要经过probate才
能分到受益人手里，probate时间长，也费钱。即使有遗嘱，如果设计分配的财产比较
大，比如十万，在加州，也是要经过probate。但是和遗嘱相比，trust是需要管理费用
的。
避免probate的最好办法是，每份财产都指定好受益人。比如，你的汽车将来归谁，某
个存款将来归谁。注意，在夫妻财产共享的州（community property），比如房子和
ira，是可以直接分给留下的伴侣，不需要probate的。
其实wills是可以自己手写的，美国有一半的州承认手书遗嘱，包括加州。格式上面网
上有些参照。wills很重要的一个问题是，如果夫妻双方遭遇不幸，谁做小孩的监护人
。这个自己写可能不能合理合法兼顾到。 我也不太清楚，是不是可以在wills里面直接
指定一个朋友或者亲戚，来避免州法庭给你指定一个。
再提醒一下，各个州的法律很不一样，要做出最 |

我的就是。网上找个格式写了到notary public那里自己签个字
就是了。你自己是trustee也就是管钱的。你可以随便放钱拿钱，
照常付税，跟自己的帐号基本上一样。

and one silly question, how does the will/trust gets executed when I enter
the western happy land? do I need to let somebody know I have a Will
locked in my file cabinet bottom draw?

这个区别不是will和trust的区别，而是怎么set up
will或者trust。
