the next few months. My current employer allows me to take a non-pay leave.
My questions are:
1. Is it legal for me to take a non-pay leave as a H1B visa holder?
2. My non-pay leave will be 11/1/2009-2/1/2010, if I find another position
during my non-pay leave(before 2/1/2009), will I have trouble to transfer
H1B? (I know last few paychecks will be needed for the transfer)
3. Will I have any problem when I apply for green |

USCIS is very tough now.
Some contractor companies (so called ICC) let the contractrs take unpaid
leave (called on bench) when they cannot find a project.
USCIS does not allow that. USCIS requires H1B holders must be paid no matter
there is project or not.
Your case is different from that. But taking unpaid leave is still a risk. I
suggest you consult an immigration attorney. |

转H-1B需要工资单，
如果在这段期间你被炒了，要转其它身份，你又拿不出工资单，就很危险；
当然，如果你再接着上班，有了新的工资单，转其它身份就没有问题

也就是说只要我能回去继续上一段时间班，转其他身份就没问题。
那我这段时间身份合法吗？我担心会对今后申请绿卡有影响
