evidence就禁不住气短，确实吗，所有证据都在韩家爷们手里，除非是雇佣神偷，FZZ
是没有可能拿到hard evidence的。其实FZZ大可不必气馁，因为在任何法律系统里，
hard evidence都不是定罪的必要条件。
大家都知道民事诉讼对证据的要求比刑事诉讼要低的多，所以这次韩家父子进行的是民
事诉讼，著作权。他们虽然口口声声说FZZ诽谤，但是到法庭上玩真的，还是知道没有
可能赢得诽谤罪的诉讼的。不然的话，直接把FZZ送进监狱住两年该有多爽。韩家父子
在掌握所有证据的情况下，连民事诉讼都没底气，北京是绝对不敢去的。就连在上海，
也要费尽心思去普陀区，为此不惜扯上该区居民刘明泽。没想到第二天网上就出现一篇
真假难辩的刘明泽的内幕文章。
这篇所谓的刘明泽的内幕究竟是真还是假，是个说不清的问题。但是HH对该文没有任何

下。
我PhD期间做的research经过我老板开的一家小公司商业化了，但是由于各种原因没有
objective evidence证明这家小公司的产品是基于我的research（虽然事实上是）。我
们没有patent，所以提供patent这条路是行不通了。公司的主页上说明做的XXX产品，
虽然关键词跟我的publication吻合，但是毕竟没有提到我的名字不好说这是直接rely
on我的研究。主页有一些技术性的照片是从我的publication里拿出来的，但是太
technical了，很难在PL说清除这些照片就是来自我的publication，公司的产品rely
on我的research。小公司的老总就是我老板（我不是公司雇员），但是同样没法直接引
申到公司的技术就是我的research。实在不甘心自己的技术确实被商业化了，却找不到
objective evidence证明这一点。希望版上各位有经验的前辈提供一下有参考价值的思

request,结果今早收到Request for Initial Evidence，心理很忐忑，会是RFE么？为
啥是"initial" evidence呢？ 放狗搜了下，initial evidence大多是485相关的，可我
都没有递485啊。

我４月２８号搬的家（我还在同一个城市），５月１号就在USCIS的网站上更新了地址
。上周五收到USCIS关于我改地址的confirmation letter.
刚刚查我４８５的状态，从Initial review变成Request for Evidence 了。是不是因
为我改地址的事情呀？我还需要出示什么证明吗？
我给律师发了封信。我们公司的律师是极其不付责任，极其讨厌的。我根本不想指望他
们。所以上来问问有此经验的人。谢谢。

case status update了，显示“On March 4, 2014, we mailed a notice requesting
additional evidence or information in this case I765 APPLICATION FOR
EMPLOYMENT AUTHORIZATION.”
我如果毕业后一直在美国等的话还好，关键早已经定了3月24号去欧洲的机票，旅行完
回国，准备5月中旬回美国。刚给USCIS打了电话，对方告知我现在不能查看Notice里的
内容，必须得等我收到信才能response, WITHIN 15 DAYS!如果要等这么久才收到
notice然后我再把evidence寄出去的话，等正式收到EAD卡，至少是在我离开美国后了
。很担心，想请教几个问题：

1. 你可以找一些引用了你方法的research articles，若这些文章发在了好杂志上或有
媒体报道，就是objective evidence of your contribution.
2. 找引用了你文章的review articles，若有大段正面评价，应该是evidence that
people consider your work important.

发帖数: 881 | 50 如果原来的Index做的很好，并且材料不是太厚，找起来不麻烦的话，可以refer到原来
的Index.
另外建立一个Index给新提交的evidence.
如果response里面用到原来的evidence不是太多，并且原来的材料太多不太好找的话，
可以重新提交一遍，注明是original submittal evidence.这样可以省得IO去找了，毕
竟IO在两摞材料里翻来翻去的，可能会容易出错。 |
