The spillover law should be reversed as previously that is the only thing
can be done for the EB-3 India relief. it is injustice people waiting for
Greencard from 2002 August onwards but people who applied(not all) on year
2007/2008 get Green cards.

Dude, there is no injustice. Everyone knows the rules, the demand is just
too high. What do you expect, the IT industry pulled in countless number of
Indians last decade and most of them want to immigrate. The smart ones
upgraded their education and switched companies to port into EB2. The rest
that stood still will stand still for a long time.

It is injustice to move the EB2I dates to July mid of 2007 in the beginning
of the FY itself with 5000 pending inventory. Not every EB3I is lucky enough
to upgrade or switch.

If you talk about Injustic, what about EB1 and EB2-ROW getting GC in 2-6

Unfortunately spillover change is a law. We cannot change it without
congress action.
Better to upgrade to EB2. If you lack the educational criteria do an MS. Not
a big deal for an experienced guy.
MS will cost around 20K and 2 years worst case. A working professional can
easily handle that.

Fortunately spill over can be reversed because this was changed just two
years back without congressional action! if at that time if this can be
changed why not now. writing to CIS and DHS Ombudsman and Secratary of State
and filing a litigation too.

The law was correctly interpreted 2 yrs ago and no one is gonna change it to
wrong interpretation again. You will be better off porting to EB2 than
endure fighting the law or EB3 wait.
For the past couple of years, Trackitt EB3 users have been told again and
again, PORT TO EB2!!!

It is not about the lobbying power. Visa office was wrong as per AC21 law.
