According to the data published by USCIS regarding the consumption of visa
numbers for permanent residence, DOS visa office obviously has been
discriminating employment-based petitioners in favor of family-based
petitioners.
The data below illustrates that the DOS visa office has been allocating
visas to family-based petitioners in a more aggressive manner than to
employment-based petitioners. As a result, when a spill over is available,
employment-based petitioners find themselves very difficult to access the
unused visa numbers from other immigration categories. We urge the DOS to
quarterly assign a minimum of 25% of annual visa quota to employment based
applicants.
Employment Based:
Q1: total visa usage 24,040, only 17% of annual quota.
Q2: total visa usage 21,944, only 15% of annual quota.
Q3: total visa usage 36,128, only 25% of annual quota.
Family Based:
Q1: total visa usage 62,955, 27.9% of annual quota
Q2: total visa usage 69,730, 30.9% of annual quota
Q3: total visa usage 67,480, 29.9% of annual quota | f********s
