发帖数: 12752 | 1 有时间时再写长一点，现在只说一下“基本权利”这个词，是有被滥用的趋势的。宪法
规定的基本权利比较含糊，主要是liberty of life and property。现实当中要活用，
但不能滥用。任何法律，基本都会针对个人的自由和财产进行限制，归根结底它们都侵
害了宪法规定的“基本权利”，但大多数是不必也不能上升到宪法高端审核的。拿刑法
来说，限制人身自由，甚至死刑，绝对的“基本权利”范畴，然则刑法是州法，联邦只
能推荐model penal code而不能强制推行联邦刑法。这就是为什么宪法里要分
classification，针对不同的class，州或联邦政府或法律要有不同的level of
scrutiny来证明其行为的合理性。
堕胎的确属于当前的“基本权利”，我又查了一下下个月的bar exam 考纲，必须承认
这一点。同时，在胚胎成活（pre-viability）前的堕胎，是属于低于最高等级strict
scrutiny 的undue burden级别，意味着 state may regulate (but not prohibit)
