一、引言

推崇之情溢于言表。
其实这些公知们对美国的司法制度和司法实践所知无几，尚若问起何以见得美国的司法
制度优秀？他们充其量是将美妙动听的理论推来导去。由于他们的误导，中国民众大多
以为美国的每个案子都得到了公正的审判，美国司法制度简直就是公平和正义的化身，
理应成为中国司法改革的楷模。
实践是检验真理的标准。判断美国司法制度的优劣，不能只作理论演择，只重形式和过
程，而不看结果如何。只有当实际结果普遍符合理论预期，才能说理论合用，制度合理
，值得学习效法。本文从实践结果的角度考察美国司法制度，即采用可反映普遍性结果
的统计数据，考察司法制度最重要的几个方面。

those lawyers could make a lot of money, like John Edwards, who basically
single-handedly trippled the premium for certain insurance. Of course Obama

This has to be a system approach, including tort reform, health insurance
reform, health care reform and even immigration enforcements.
But the bottom line is free health care has never been and will never be

because employers will opt-out the current health plans they provide and
