标 题: CPT快过期了,OPT还在TSC没批,公司说要terminate+rehire怎么办

如题,CPT五月中旬过期,OPT三月初交的还没消息。昨天HR跟Manager一起与我开会,
说如果到时候有gap的话必须要把我terminate并且从payroll上拿掉,我和manager一致
以为只要到时候take unpaid leave之类的只要不工作就行了。不知道是否这种情况必
须terminate+rehire才行?公司是某八万人的跨国大公司。

那就看人品了,一般正规公司怕惹官司,最多回答到是否rehireable这个程度。但如果
新东家care的话还是有可能失去机会的。

我之前经历了一家特别恶心的公司,当年用不正当手段使我离职。我之后重新找工作,
但是人家做background check的时候,他说我 not eligible for rehire,结果我失掉
了工作机会。我们之前是有合约的,也就是他之后评论我的工作时间及职位,其他一概
不会说,但是他现在等于breach agreement了。更可气的是,我失掉工作机会的公司又
不给我出具他们说 not eligible for rehire 的证明,导致我现在没办法告我以前的
雇主。
我现在还在找工作,之后还会面临background check的问题,恳请大家帮我想想怎样对
付这种恶心的美国老板。

就是正常的入职background check,问would you rehire the person,他们应该说no
comment,但是他们说我not eligible for rehire。我原来这家公司非常小,现在一共
就5个人,hr就是老板的人,那还不让说什么就随便说什么。
background check不是都要打电话的吗?否则他们怎么verify呢? 还请教,谢谢!

绝不能说是被FIRE了!!!再和新公司解释CASE的事情都很难说通,“他说在我的ref
上只写是因为公司经济不好”。好好和你的FORMER SUPERVISOR 或者HR 沟通沟通,达
成一致,让他们帮你这个忙,就说是LAYOFF 因为经济不好。
如果你提供的REFERENCE不能帮你圆这个谎,就换个REFERENCE.
但REFERENCE CHECK通常会问FORMER SUPERVISOR一个问题,"WOULD YOU REHIRE XXX?"
"HIS/HER STRENGTHS/WEAKNESS", 总之,你若要你的前老板作REFERENCE,你必须和他好
好沟通一下。
其实不少公司有政策,不允许HR给离职员工作REFERENCE.你如果非要选你前老板做
REFERENCE,你可以让他说,CONFIRM你的职务,EMPLOYMENT DATE等基本问题,关于其他
问题,WOULD YOU REHIRE XXX? 类似这样问题,不允许回答。
总之,争取最有利条件,别说被FIRE了!!!

您没在职场混过吗?Perfomrance不好,不能换组,直接下个QUARTER FIRE你。另外,
PERFORMANCE不好被赶走的,都不算LAYOFF,是FIRE,没PACKAGE。LAYOFF是你干得还行
,公司业务问题,以后优先请你。PERFORMANCE不好原因被FIRE的,一般上公司黑名单
,永世不得录用,NO REHIRE。所以情况不对,自己就要先跳槽,以后还有可能在回老
东家。被搞个NO REHIRE,这辈子别回来了。

晕倒,你的逻辑就行了?对于没权没势没人脉没身份的人,只能靠自己去避免一切可以
避免的UNCERTANITY,即使1%的可能性,发生在个人头上就是100%。而且我说的不要和
公司和MANAGER斗,三十六计走为上策,尽量不要被人赶走。退一万不说,即使被
TERMINATE然后拿到PACKAGE,你以后也不会被同一个公司REHIRE了。为什么人家给你
PACKAGE,是因为封你嘴放弃任何起诉权利,但是以后你也别回来了。(不讨论个别情
况)。如果你自己走,你ELIGIBLE FOR REHIRE。话到此为止了,我写这个也不是给你
看的,想看的人自己会知道我得用心,根本不是吓唬人,是给自己留后路,避免不必要
的麻烦。

就算前老板恨死你了,也不能随便说you are not
Eligible for rehire。
你要担心这个,在可不可以contact 你现在的employer
那一项,直接选no 好了。我从来都是选no,至于怎么去
Verify 是他们自己的事,他们自有办法。

在这家印度咨询公司干了大半年被terminated.
主要原因当然是我和印度老板不和,他自己没一次上午12点前到办公室,我有一次10点
到就被训了。
直接原因是5月初给客户做成果汇报,客户觉得有些数值偏低让我们检查data clearing
有没有错误,但是我的印度老板直接要求我重写model code,但是这部分由客户他们自
己的模型组负责。之后就一直训斥,他自己拒绝做任何事情 全把责任怪到我头上。于
是我给老板的老板写了封邮件说这个老板对我非常偏激我想离开这个项目能不能换个项
目,两周之后大老板(也是印度人)通知我被terminated.(写邮件的时候已经考虑道
不利的结果 但是没料到terminate对下家公司是个red flag)
termination letter没让我签字也没写任何原因,但是最后一个月多给我一周薪水我
推测是一般的layoff.
现在挂在同学开的公司(everify的)拿了OPT 延期卡 已经四个月了
到现在经过了差不多10次电话面试 几乎每次都被问离职原因,我都是按实话说的 然而
都没有后文了,所以我想问一下是不是换种说法比较号, 比如project完成... 阅读全帖

但如果你有实力进入其中一家,没理由不能进入其他一家。去年因为泄露google机密被
炒的那个员工的履历表,简直就是十几家著名公司的list,有ms,google,facebook等
等。

If you report to HR, your managers will know that you disagree with their
decision, which will make your situation in the team harder.
Better do that after you find a new job.
I don't think reporting this to HR will hurt your rehire opportunity. You
can ask them if you are eligible for rehire before your leave.

我是被雷的, 当时的经理是个黑人, 在最后的档案上写了很多不好的东西. 其实也没啥

个人觉得如果你还想回你可能被开的公司(被开很多时候是和MANAGER不对付),还似
乎自己主动走好,因为被开了,公司的RECORD上面是NO REHIRE。自己走,以后去别的
部门,或是那个讨厌的MANAGER走了,可以有机会再回来。不知道澳洲那里怎样,反正
美帝是这样的。LAYOFF是另外的事情,和你能力无关,以后可以回来。

求问下,之前是用OPT作full-time employee.但是opt要过期了需要用cpt接上,
1。那用cpt的话必须terminate 现在的full-time regular status 转而以intern身份
工作, 对么?有没有可能cpt仍然是以fulltime的状态工作?
2。听闻intern和contractor也很不同,而且intern的工资很低?

intern低不低,看你公司hr给你多少 /hr。我就是opt到cpt,一直full time,福利股
票一点没少。当然,要把自己manager玩转,要把自己hr玩转
