所以虽然优先日期倒退，照理来说CIS仍然可以批 准I-485，但是多半CIS都不会这样做
。也就是说明明你的I-485是有名额的，CIS还是会把你的I-485卡住。这是很不合理的
。当然这批准与否的决定权控 制在移 民官手 上。所 以我 们不时的看 到仍然有很多
I-485似乎优先日期倒退也批 准。一般来说如果你的I-485被转到local CIS，这 些
local的移 民官是根本不可能因 为你已有名额而好心的把你的I-485拿出 来批准。但
是在Texas Service Center就很有可 能。我们这几天就收到好几个EB-2的I-140及I-
485同 时批 准的案 件。这几个案件的优先日期都是在2006年10月之后。我们由此看出

经过版里筒子一顿教训，楼主知错了。。H1B的确来之不易。。楼主也想好了，先保H1B
为重。
没想到今天又有新进展！！
新公司的HR打电话来说，他们有可能说服律师帮楼主transfer H1B！但有一个前提：无
论denial还是approval，都必须选择新公司了，i.e.，不能说transfer denial的话还
想回旧公司。
现在楼主想跟大家分享一下最近搜索到的所有关于10月之前transfer的信息。也求大家
知道的信息和input！
1. 楼主给至少15个移民律师打过电话，大概一半说可以，一半说不行。说不行的律师
大多提到了移民局最近的新规定新理解，就是10月之前的transfer不能exempt from
cap。而在2014年之前都是可以的。

但我的意思是说, 就从上学这个问题上看, 实际上有比AA
更影响华人利益的行为. 比如, 虽然不是明着来, 但不少地方
确实(让人感觉)招生时有quota存在. 这个quota, 就是压制
亚裔而让白人得利的东西 - 因为亚裔中强的学生明显超过
亚裔人口比例, 所以亚裔最受损. 咱们损失的这些名额, 给了
其他族裔. 老黑当然也受益, 但他们人少, 就算受益也有限.
受益最大的, 是占社会主体的白人.
这个quota的效果, 比AA让黑人得利对华人造成的效果要大(我认为).
这个quota实际上与AA的精神是相背的, 所以白人当然可以去反对
AA(但同时对quota问题视而不见).
咱们受quota所害的人, 就不能对之视而不见, 或者假设AA没有了的话,
quota问题也同时会解决. |
