would be different depend on availability of weapons type, societies opinion

今天老公突然灵光一闪，设计了两幅海报。第一张是借鉴了一位网友的设计，特此谢谢
他。这一张就是如果这个议员不给我们投反对票，我们到时候就把他的名字写到括号里
，明确我们不支持他，让他以后失去政治前途。我们直接把Racism写上去，许多老美一
看马丁路德金和Racism，应该就愿意来支持我们。老公还耐心地辅导了六岁的儿子画了
几只彩色的猴子。儿童画因为毕竟可爱希望能抓到眼球，让别人愿意过来了解，到底是
怎么回事儿呀。
儿子听说要画猴子，十分不解问:“爸爸,这是干什么呀？”
我答道:“爸爸在为你而战呀！”
儿子问：“啊，要流血吗？”
我再解释说：“这是一场不流血的战争。这样你们以后才不会被别人因为你是亚裔才欺
负你呀。”

对非法庭的其它人的confession（有privilege不算，比如夫妻之间，客户和律师之间
）在审判过程中同样可以作为证据。在被警察限制行动自由状态下对警察作出的
confession必须要在警察给予了Miranda warning（你有权利保持沉默和请律师在场）
后才能作为证据。这也是为什么美国警察逮捕后立即会给予Miranda warning的原因，
因为只有这样之后被逮捕者对他们说的话才能成为证据。美国证据规则中的hearsay
规则有一个例外叫statement against (penal) interest。你可以去查是什么意思。

德州休士顿一位华人与妻子1月4日从家中外出用餐时遇劫，他掏出随身手枪反击。妻子
亦从自宅拿出长枪追击，此举是否自卫过头，甚至角色对调变谋杀，引起全美热烈讨论
。警务人员表示案情得通过检察官与警方调查还原现场，再由法官或陪审团决定，外人
难从初步的文字描述判断是非。
这起引起热议的案发地点在德州，当地对枪枝管制较为宽松，与加州有相当程度的不同
，无法相提并论。现在洛杉矶市警局担任第一线外勤警员的王以安说，以世界日报刊载
的过程判断，此举应为纯自卫，但一样的场景搬到加州，妻子拿枪冲出就变追杀。加州
无自卫法（Stand your ground）条文，但城堡法（Castle Doctrine）Penal Code

宫请愿去! 瞬间之下，请愿书就凑够了十余万华人的签字。人数到了十万，白宫就必
须表态。
侨居美国28年的我，还是头一次看到华人如此齐心，我脑海里顿时涌现了十万人肩并肩
手挽手，高唱着“团结就是力量” 往白宫走的场面。十万人签名对美国人可能是个大
数，对于有着起哄架秧子传统的炎黄子孙，这点人真不算什么。
后来我转念一想，华人联名让白宫表态，这不等于把白宫当成“党中央”了吗？
这不等于在美国玩中国的老一套----- 出了大事儿找组织，遇见坏人找领导，你打了我
我告你妈去，有了冤情去中南海上访，，，，，总之，华人觉得白宫里有个黑人包青天
，他会给咱草民做主的。
这已经不是第一次华人大举向白宫签名请愿，这说明在输出春晚，土豪，剩女，大妈广
场舞之后，上访也被输出到了美国。
起诉不起诉一个人，是地方检察官的事，用十几万人民的呼声吓唬白宫，逼着白宫表态
或者干脆下令赦免梁警官，这不就等于让白宫凌驾于司法之上吗？美国好不容易花三百
年建立起来的三权分立，这么轻而易举就让中国人给废了，可惜。

律意见。只想抛砖引玉，希望能有专业人士出现。
很多人的想法是Peter Liang有过失导致他人死亡，判他过失杀人不冤。这是从中文字
面出发的简单理解。其实，这样的中文字面在法律上都不严谨细致。
Peter Liang这次被判多项罪名成立，其中最严重的是second-degree manslaughter成
立。请注意，纽约州的second-degree manslaughter成立的条件是“He recklessly
causes the death of another person” (同法条下的堕胎致孕妇死亡及导致、协助他
人自杀显然不适合本案)
recklessly是什么意思？在美国作为各州刑法普遍参考的Model Penal Code把犯罪意图
（Mens Rea）分成从重到轻的Purpose、 Knowledge、 Recklessness、 Negligence四
种。

梁警官不恰当的指控。我不由想到自己正在面对的不恰当指控，而且检控官还是我们自
己华人！心中很是感慨，想和大家分享一下我的经历。
事情开始与一次road rage,一个菲律宾女人在stop sign没有守规矩差点撞上我，我当
时有点激动就cut off她了，然后再她前面逼了她一下，于是她也被惹到，跟着我回到
了apartment gate的口，在我等大门开的时候下车冲了上来，气焰嚣张并出言不逊，我
在她接近了我的车之后才下车，交换了一些dirty words之后，她把手上的太阳眼镜甩
到了我脸上。我出于本能反应还了她一掌，但是我敢保证是非常有分寸的一掌，绝对没
有下狠力，打在了她的头上。她的反应也证实了这一点，她并没有表现出疼痛，继续很
嚣张地骂骂咧咧，并在我迅速回车之后还用力敲打我的车窗。我不想事情闹大就回家了。
她报警，并且和警察说她头晕，警察有检查她的头，完全没有任何可见伤痕或任何肿起
（在警察报告里警察说由于她头发浓密，无法辨别伤痕）。可是警察还是在听说她去医

我会这么说，这位public sector的州congressman may not meet the requirements
for the penal code charge of "inciting a riot", but his unequivocal and
public advocacy and promotion of mass violence (riot) as a result of the
judicial branch's review is a dangerous insult on the ethics that all
public
sector members must comply with. so i complain.

事实上我觉得最近20年，黑人应该是被under penalized,当然不排除有一些冤案。在美
国任何人种都有被冤枉的，而且很多。 |
