提成的。要是他们这帮律师光从property damage里提成30%，那得有多少撞车的才能养
活得起他们这帮人啊？30%是非常厚道的了，不过你得搞清楚这30%有没有猫腻，自己
Google吧，另外签字前看清楚合同。
那帮律师叫做“personal injury lawyer" 是有原因的 - 人家是从你的personal
injury"的赔款里提成挣钱的，至少30%，一般是1/3，有的可能高达40-50%，但是这是
指对方保险公司陪给你的"personal injury"那总钱数的比例，和陪给你的车钱没任何
关系。personal injury，像你这样的，两个人受伤，还有骨折，保守估计，起码对方
保险公司得陪十万（如果那厮的保险保了这么多的话），然后律师拿3万，剩下的你把
看病的费用清了，估计还能剩三四万。要让你自己去对方保险公司要，你觉得你能要回
这么多钱吗？律师学的就是这个，人会就会在能写出一封牛哄哄的赔偿信，让对方保险
公司不得不陪你多少多少的银子。

上次我引用IIHS 2011年的报告

指出在2006-2009年Volvo唯一有数据的车型XC90每一百万车年死28个司机（仅仅司机）
。同时和XC90非常接近的Acura MDX死了11个司机。Ford Edge 表现很好，保护了所有
司机。另外本田的Odyssey和Pilot表现也很好，成绩是17和20。因为有人质疑这个数据
是否有足够说服力，我把更早的一个IIHS Death Rate报告找出来。这个是IIHS 2001和
2004年间的报告。

然后10天就10天就华丽丽的撞车了。 本人是属于驾驶记录比较好的， 所以我自己买的
就是liability保险。于是当时提车出门的时候，我也就叫她买了个liability。结果这
一场撞车下来，我室友的责任，7500刀买的车现在要自己出$5300修车。这台小车车很
可怜的躺在修车厂三个月无人问津。鉴于我室友的前车之鉴，我默默的收起自己的flag

然对静态测试持怀疑观点。因为首先，静态测试不能模拟人在翻车时的受力情况——而
翻车时人员严重伤亡多为头颈部受伤引发，这就跟头颈部受力有关；其次，一次静态测
试通常只随机测试车辆一侧，这就无法测出车顶在一侧受力之后另外一侧再受力的表现
——而翻车车辆时常会受到两次撞击，其中近端（翻车初始先受力的一侧）往往比远端
受力小；再次，敞篷车都谈不上顶棚，那按照静态测试的逻辑，敞篷车应该是表现最差
的一类车——而IIHS的统计（驾驶员翻车死亡率，1984-2005）似乎也不太支持这个推
论（下图）；
最后，静态测试测得的车顶强度可能都不是真实强度，挡风玻璃在这种测试中可以提供
很高的强度——而这就意味着车厂可以在不加强顶棚的情况下蒙混过关（如下面这个
IIHS测试视频，15秒时这辆LaCrosse达到peak force，同时挡风玻璃破裂，然后强度就

为了减少在虚拟世界浪费的时间，一两年前我改了账号密码，基本不来车版，偶尔来了
也是潜水。最近因为想了解一下三排座SUV和Minivan，又过来混了一会儿，见到很多熟
悉的ID，还有某些日复一日关心别人买什么车的毁人不倦的ID :-)
闲话少说，我在车版还是学到些东西，所以冒着被老婆骂的风险来发个帖子。那些百万
车辆死亡率的数据固然有一定参考价值, 但其一误差太大，毕竟每年车祸死亡3万人，
其中还包括行人、自行车和摩托车，剩下的也只有一部分涉及最近几年的乘用车型，最
后平均到每一车型只不过几十人、最多上百人的数据点，所以大家会发现很多很难解释
的差别；其二数据没有经过必要的修正，有些妓者脑子比较简单，有些有商业利益驱使
，导致得出的结论经常比较误导，经不起推敲。
我最相信的安全统计数据是 IIHS车祸理赔数据IIHS insurance-loss-information。其
一Insurance loss比车祸死亡的覆盖面大得多，样本数量大，误差自然较小。大家可以

简单的回答是不一定。我不是学法律的，下面的信息都是网上扒来的，如有谬误，请大
家指出。
一般的刑事民事法律在美国是州法，所以不同州的具体标准不同。使用枪械自卫在不同
州大致遵循三种不同的原则：1，Duty to Retreat; 2,Castle Doctrine; 3, Stand
Your Ground.
解释一下这三种原则：
1.Duty to Retreat。 面对侵害，首先要后退回避，屋子外的可以退到屋子里，屋子里
的可以退到屋子外，只有在确实没有安全退路的情况下才可以使用枪械自卫。应用这种
原则的地方，开枪自卫者需要举证说明自己开枪前已经退却了，如果可以回避侵害没有
