（1）美国总统制的成功不可复制。
以总统制为特点的美国宪政制度，对许多有志于宪政民主的中国人有着巨大的吸引力，
但中国能否透过效法美国的总统制宪政制度而复制美国的成功？很遗憾，不可能。拉丁
美洲、非洲、东南亚早已有数十个国家以美国宪法为蓝本制定了总统制的宪法，它们中
有没有哪一个成功建立了长期稳定、不曾崩坏的民主政体？一个也没有。中国如果以美
国宪法为蓝本制定新宪法，很可能逃不出这一魔咒。
为什么？总统制导致的行政部门与立法部门双重民意授权，以及总统大选的“零和赛局
”性质，是许多国家政局不稳甚至宪政崩坏的主要祸源。换句话说，诸多总统制国家宪
政崩坏不一定是因为宪法赋予总统的权力过大；即使总统或当选人是老成持国之士，即
使议会有足够的自律，总统大选的失败者及其背后的势力也有可能掀起政潮，这是总统
制的制度性弱点。全民直选总统的半总统制也面临类似的问题。政治学领域许多学者的
研究表明，总统制或接近总统制的半总统制在美国之外宪政传统并不深厚的国家容易导
