美洲、非洲、东南亚早已有数十个国家以美国宪法为蓝本制定了总统制的宪法,它们中
有没有哪一个成功建立了长期稳定、不曾崩坏的民主政体?一个也没有。中国如果以美
国宪法为蓝本制定新宪法,很可能逃不出这一魔咒。
为什么?总统制导致的行政部门与立法部门双重民意授权,以及总统大选的“零和赛局
”性质,是许多国家政局不稳甚至宪政崩坏的主要祸源。换句话说,诸多总统制国家宪
政崩坏不一定是因为宪法赋予总统的权力过大;即使总统或当选人是老成持国之士,即
