China Employment Fifth preference category at some point during second half
of fiscal year 2013. Such action would be delayed as long as possible,
since while number use may be excessive over a 1 to 5 month period, it could

Many people come to USA from China, a lot of them are J1 and H1B visa, some
J1 visa and H1B visa holders even filed EB1 and NIW in the first year. So
the visa demands increased a lot after 2007. |

CP is Consulate Processing, CP need not file 485, they need file I-824 to
national Visa Center (NVC) only when PD is current, filing fee $320/person,
FP fee $74/person, immigration visa application fee $720/person. They need

So I think these 11866 EB3C and 1022 EB2C are all PD before summer 2007.

1）USCIS Ombudsman Annual Report 的报告；
2）一位议员recapture bill的proposal.
这都不是法律条文。Sliva case 法庭recapture了。
而且USCIS Ombudsman 前首席律师给我们做证，当年demand大于supply时，USCIS浪费的名额
是可以recapture的。如2006年。
关于7%，每年EB4C,EB5C都用不完，EB1C,EB2C用的spill over不算7%， 还是有空间补
EB3C的。

On the contrary, EBC will see little change or decrease.
That's all because EBIs are mostly ICC transferred cheap tech workers, while
EB2Cs are mostly graduate students seeking jobs in US, which will

发帖数: 1987 | 15 今天略微读了一下法案，HR3012对EB3C绝对有利的部分是他把每年因为六四学卡扣除中
国1000个EB的名额给还给中国了。按现有法律规定，因64学卡多发给中国的名额要在每
年中国EB名额中扣除1000还债，300扣在EB3C，700扣在EB5C，所以现在EB3C每年名额是
2503，不是2803，300就是64学卡扣掉的。
所以EB3C每年拿到的份额占全世界EB3总名额40,040的6.25% （2503/40040），7%都不
到。
去掉7%限制以后，相当于中印与全世界捆绑，只要EB3C每年递交的申请占全世界EB3超
过6.25%，情况就比现在好。
那有人会说，今后每年EB3C申请人数不到6.25%不就亏了？须要注意的一点是，按照法律
，任何国家的排期不能超过ROW的排期，所以说不管你这个国家EB3人数多少，即使是梵
蒂冈，瑙鲁这种袖珍小国，EB3人数为个位数，也不能超过ROW排期。所以EB3C将来人数
即使再少，排期也跟梵蒂冈，瑙鲁一样。假设这个法案没有通过，EB3C的排期最好的情
况，也是跟ROW排期一样，不可能超过ROW，跟法案通过全世界捆绑的情况一样。 |

发帖数: 2769 | 22 看一下 http://data.niunational.org/iv-stats，除了去年 FY2011 和 FY2007 外，EB1 每年都用了差不多 40000 个。所以不是“明显用不了”。
奥本说今年 EB5C 可能出现排期，这个意思就是 EB5 的 10000 都会用完，不会有剩余。
EB4 的情况不是很清楚，往年有时能用完有时只用一半。乐观估计可以支援 EB1-3
5000 个左右。
今年的 EB2 有一个不利因素，就是 ROW 需要花掉往年 5 个 quarter 的 demand，因
为去年 EB2I/C 多吃了。
加在一起，就算不清楚了。 |

出来基本也是走H1b-EB123这条路的，所以从职业移民里面偿还也不是一点道理也没有
。另外每年偿还1000个名额中300从EB3C出，700从EB5C出，但EB5由于长年All C，所以
那每年的700偿还基本等于免了。实际就是每年EB3C还300。 |
