，本身就不binding。还有另外一个PA的案子，那个人绿卡上述赢了的，后来其他人都
引用这个案子，移民局说我们不需要follow他们的decision。
有最好了，没有也无所谓。文科就解释清楚呗。没有citation，也没准可以有不同的办
法来证明的。 |

文章，刚才搜了一下，找不到他文章的原文，但是有人引用他在1960年发表文章中的两
个观点总结，似乎有很大的偏差。
这些都是正常讨论，观点不同很正常，时代不同，以我们这个时代的认知，去讨论一百
多年前的结论，不那么简单。你能讨论到这个层级，下些功夫去看美国人的学术文章，
相当具有水平。

越位后射门可以是，也一般是lecture，而不是caution
如果出黄牌，是给“浪费比赛时间”的“unsporting behavior”
或者纯属发泄的“express dissent”， LOTG里面没有“越位后踢球犯规”
这一条黄牌判罚。
比如1:1的比分下，巴萨的越位球射门，只要不是发泄动作，根本不会吃牌，
因为缺乏浪费时间的动机。
范佩西是明显听见了（比如动作有停顿，回头看裁判看边裁etc）吗？
是发泄的射门吗？如果不是的，裁判在阿森纳扳平后马上罚下阿森纳的队员，
几乎一定是受了指示或者收了钱。
你要知道，裁判最大的一条原则就是“不能操纵比赛”。 |

大致上，就是一个密歇根一白女，上法学院被成绩不好的老黑顶替下来了，告学校，一
直告到高院。高院5:4支持学校。chief rehnquist dissented.
然后，密歇根就通过州法（类似加州），严禁用肤色当作录取衡量因素。后来有人告密
歇根州法，现在正在高院的路上。在高院判决之前，密歇根州法还是法律。
上次诗人也说啥犹他州法也改了，其实没有。在高院判决之前，州法是有效的。
这也行？这加分加多少啊？占总分数指标多少%？怎么quantitfy加的那部分thinly啊？ |

grutter v. bollinger的chief rehnquist就是dissent，其实密州的这个aa，就是一个
thinly veiled quota，其实是违宪的。
drunkpiano有篇关于AA的文章，收在她的书里，按她说法，高院的判决都是和稀泥，不
能量化quota，但AA也不违宪。目前还是这样么？
