楼主，你想剥夺的是他的legal custody，这和大家常说的监护权还不一样。我们常说
的监护权，是指physical custody。大部分离婚，父母争夺孩子的physical custody，
就是指谁照顾孩子，很多时候是母亲，尤其在孩子小的时候；然后根据这个physical
custody的结果，以及双方的收入情况，再判child support,就是孩子的抚养费。legal
custody在绝大多数情况下都是joint的，你很难剥夺其中一方的权利，除非他放弃，
或者你能证明他abandon了孩子。所以你想要的结果非常困难。
而且以你目前的状况，连你争取physical custody其实都不乐观，因为你没有收入。如
果你到法庭上说你要把孩子送回国去，然后你留在这里工作，你就死定了。虽然很多没
有工作的妈妈都能顺利拿到孩子的监护权，但是人家是有婚姻关系的，是离婚；你这个
什么都没有，离了婚没有赡养费，自身难保，现实中你没有办法说服法庭你能够照顾这

基本上，你们两谁都不是罪大恶极的人，legal custody是不能剥夺的，包括孩子的教
育，健康等。physical custody，孩子跟谁，在美国，至少是我所在的州，主要看现在
谁带孩子更多，更工资不搭界（有配偶赡养费和子女抚养费），这样做的主要原因是尽
量不给孩子造成不稳定的感觉。你的情况应该是你孩子他妈工作以后几个月的情形，谁
主要负责带。不管这样，哪一方都不可能拿到100%的physical custody。所谓美国主要
是跟女方，纯粹是瞎猜。
两个custody都是指如果事情非要弄到法官、调解员那里的情况。最好是协商解决，要
不然都是输家。
“想把孩子送回国的寄宿学校去,还说这是最佳方案”，只能说明这个妈妈并没有带孩
子的决心，只要你能证明这是事实，调解员肯定支持你主要带孩子。当然如果你也只是
一时间觉得没孩子了不好，并没有长期抗战的思想准备，那么从孩子的角度，最好还是
和孩子他妈共同抚养。

but with your new family, can you contribute as much to your children as you

In my state, parental alienation is very serious and there
are numinous cases that the custody is awarded to the victim
parent, among many of whom are fathers. The fact that my son
is only 4 is an advantage for me as his preference will be
