贺梅案新变局 贺梅三姐弟回美国过暑假(图) 明镜
贺梅回到孟菲斯（Memphis），将在此渡暑假。
周五（7月1日）12岁的贺梅抵达孟菲斯，她与她的弟弟安迪（Andy）及妹妹艾维塔（
Avita）同行，而贺梅父母因为没有护照所以没有同行。
当年扶养贺梅9年的贝克夫妇被允许在飞机出口外迎接他们三人，而贝克夫妇其他亲友
则在出口处等候。
贺梅表示很高兴回到孟菲斯，也愿意回到孟菲斯。此番他们是到此渡假，安迪还要藉此
机会，做一个外科手术。

还没有最后的final court order之前，所有的都是临时的。父亲如果要争还是可以的
，但是因为
对方得了先机，机会很小。
美国给custody不是看你收入，工作，主要是看who is the primary care provider.所
以在
这个意义上一般都是妈妈拿到custody,爸爸给child support和visitation。
LZ现在也不是看不到儿子，一般可以去法院申请visitation，除非LZ做过什么很严重的
虐待孩子的
事情，visitation都会给 |

子只是希望告诉一些在婚姻中不幸的姐妹，你的很多权利在美国是有法律保护的。
离婚时如果有任何关于财产，孩子的问题，一定要找专业人士，也就是matrimonial
lawyer解决。像看医生一样，骨头断了要找外科医生。找律师也要对症， 离婚找移民
律师是解决不好问题的。
离婚是很复杂的问题，涉及Child Custody， Alimony， Property Distribution，
Child Support， 有401（K），Enhanced Earning Capacity。
女性，特别是StayHomeMom， 如果对美国法律不了解，就不能保护自己应该得到的权力
和财产。离婚就算没有财产，没有孩子，还可能存在伴侣继承的遗产，401K帐户， 银
行账户，投资帐户， 婚前财产，研究生学位等各种财产的划分。孩子的Custody还存在

在美国一般是这样的，小孩儿基本是母亲有physical custody, 没有physical custody
的一方付对方抚养费。每个州都有一个公式，基本的抚养费是一个大概相对固定的数，
在此基础上， 根据夫妇双方的收入，小孩儿的托儿费用，校外活动费用，医疗保险费
用和甚至将来上大学的费用是按夫妻现有收入按比例分配的。如果任何一方的收入有明
显的变化或小孩子的花销出现明显的变化，任何一方都可以在法院递交motion来要求修
改court order. 如果一方没有工作，有些州还可根据婚姻的长短决定无收入方是否有
资格领取对方提供的赡养费。具体的事情很复杂，特别是双方对费用摊派分歧比较大的
时候，最好是咨询专业法律人员。 |

美国非移民签证的新申请表格 DS-160 在沈阳领馆试行之后，从下月（2010年3月）开
始，将在全国正式实行。
新的 DS-160 表格取代了以前的 DS-156、DS-157 和 DS-158 等表格，只能在网上填
写。
DS-160 适用于除 K-1/2 (fiancee) 以及 E-1/2 (Treaty Trader) 的所有非移民签证
的申请。

贺梅于7月1日重返孟菲斯度署假，贝克感激

当贺梅姐弟三人出现了孟菲斯国际机场，当地人在惊呼。尤其是12岁的贺梅。这么大了
，贝克都在惊叹。
贺梅目前的情况：12岁，身高1.4以上，家住在一个漂亮的富人区（带室内与室外游泳
池），就读于重庆某“贵族学校”，三好学生，成绩全A，说流利汉语，汉语语文96分
，数学96.5分，英语就不用说了，在班上名列前茅，多次获奖，会弹钢琴，会打乒乓球
等等，很多课外活动，从来不需要补习功课，在学校有很多朋友，与弟妹关系很好，据
说不少男生喜欢她，她很得意。
整个旅程的费用都是由罗秦支付，购买了来回机票，原定八月底回去，但贺梅说要做暑
假作业，因此将返程提前。
