商分数70分作为是否执行死刑的分界线，从而在死刑判决方面给存在智障的被告提供了
更多保护。
美国最高法院的九位大法官以5比4的表决结果驳回了佛罗里达州的裁定。大法官肯尼迪
(Anthony Kennedy)在判决中写道，佛罗里达州的做法忽视了现代医学标准，现代医学
标准认为智商分数是一项不精确的衡量标准，不应仅凭智商分数来断定一个人的智力情
况。
肯尼迪称，当智商分数落在测量的标准误差范围内时，被告有权在量刑时提供有关其智
力缺陷的其他证据。
此案中的被告霍尔(Freddie Lee Hall)被判在1978年与他人共同绑架、殴打、强奸及谋
杀了21岁的新婚孕妇赫斯特(Karol Hurst)，还被判在随后又杀害了副警长科伯恩(
Coburn)。
佛罗里达州最高法院此前维持了霍尔的死刑判决，原因是他的智商测试分数高于70。
肯尼迪在代表五位投赞成票的大法官的意见中称，佛罗里达州试图对一个人执行死刑，
