子的妈，感觉很痛心，也很生气。一气是三个20岁的年轻力壮的青年，都没能抵抗住一
个据说身高很不高，也瘦小，在高中被同学无数次bully的疯子，三个人都没有反抗的

梁彼得。起因如下，据说梁警官执勤时出现意外枪支走火，子弹反弹误中黑人致人死命
。因此纽约检察官起诉梁警官，二级过失杀人罪（aggravated manslaughter）。
在我看，这个起诉非常合适，任何人使用枪支不当造成他人伤亡，与驾驶不当交通肇事

1. DA 控人，不需要有“明显”的证据，只需要" probable cause", 也就是有合理的
可能性犯罪已经发生了，DA就能charge你。
2. 不要怕DA charge, 他们要convict 你，必须要有证据来beyond reasonable doubt,
有些时候DA也会承受一些压力，或者是来自他办公室的选区，或者是他的上司，所以
他们有些时候会“漫天要价”。他们如果不能convict 你， charge你谋杀都没卵用。
3. DA 的确是控诉你一个“aggravated battery”, 这是battery里面一个加强版本。
但是不是说，他控了你，他就能赢
4. 他控诉这个罪名，那么他要拿出证据来证明两个要素，并且要beyond reasonable
doubt. 1) 你蓄意以一种有害的或者是侵害的方式接触了那个女人的身体。2）这种接
触导致了那个女人极大的身体伤害。
5. 第一个要素，从你的陈述来看，对方是拿到实证了吧？有人看到你打了人家，还是
你已经承认了？

rape. what is the purpose of aggravate the injury to the victim? It may be
a surprise to you, but the law is like that here; every time you have the
girl going to court and repeat what happened - it's like been raped one more
time. That's why if he took the plea bargain, it's just 3 years. but if he
denies, and make the little girl live the nightmare again, it's much much
longer sentence if found guilty. |
