美国别的州里的事儿不知道，就说说我们加州。
加州自2012年选举以来，民主党在州议会已经形成绝对大多数(super majority)。州参
议会40位议员里28位是民主党，11位共和党（一位空缺）；众议会里80位议员里55位民
主党，25位共和党。有绝对大多数的好处就是吵架的少了 – 以前州议会经常吵架，
尤其是在每年州预算出笼的时候，两党各执一言，僵持不下，预算一拖再拖。到了实在
无法拖了的时候，两会议长要把议会大楼的门锁起来，勒令议员们日夜连轴转，预算不
出来不许回家。有两年州政府不得不发IOU给所有要付费的地方，实在尴尬。但是，民
主党这个绝对大多数来得晚了点，因为在2010年，加州选民通过Prop.25, 决定州预算
只要有大多数议员投票过了就可以，不用再像过去要2/3绝对大多数议员同意了才可以
通过。尽管如此，民主党有了绝对大多数，在议会里基本上就是可以为所欲为了，共和
党反对是没有用的，正因如此，民主党的提案，包括那些需要有绝对大多数通过的一般
都会轻易通过，SCA5只是一例而已。

刚上学，没啥好说的，我的临时老板就是丫，在丫组里呆的不爽，因为还没做实验
，坐在那里，别人在你后面走来走去，你干点什么别人都看得见。后来没上课的时
候我就去图书馆了。丫跑来问我为啥不在它组里。后来我问别的人，没有别的老板
这么问过。既然丫问了，当年我老实，就回去坐着去了。事实上后来发现似乎只有
丫的组办公室是这个格局。丫每天跑办公室比跑厕所还勤。
后来分老板，当年我进这个学校的时候是丫招进来的，我年少无知，看了丫的文章
，JOC,JACS若干，觉得很牛（现在JOC/JACS让我看来废纸都不如），就嘴贱要跟丫
。后来到了选老板的时候，别人说丫tough，我自己觉得一来我早决定跟他，变卦不

8月份 全职工作
9.1 -9.15 leave of absence (unpaid)
9.15-9.30 leave of absence (unpaid)
10.01- 10.15 get paid 2 周薪水 不用来上班
10.15- 11.15 get paid 4 周薪水 不用来上班
求问
1） Leave of Absence 对H1B是否可行 ？ 用开medical leave 的证明吗
2） 找到工作要转 H1B的时候据说要3个月的薪水,但我只有6周（1.5个月）3个pay
check 是否可行？
这个有具体USCIS 网页吗？公司说要给他们看具体要求是不是 3个月
3） 现在转 F1 不知道是否来得及，有没有知道bay area 比较好的挂靠学校？
第一次遇到这样的时候，都不知道该怎么办了。。。，希望各位好心人帮忙 |

我H1B确定抽中之前也有类似问题，当时计划是美国总部这边在我OPT过期之后直接把我
的工作停掉，我本人absence of leave，所有的IT全部关掉，然后relocate到中国。
你的情况是不能relocate，但是absence of leave总是可以的吧？ |

Leave of Absence can be valid for H1B but under conditions:
1. You voluntarily request;
2. It can not be too long;
3. You will return to the original position after leave of absence;

这个用之前的pay stubs或者就两张pay stubs即可；没有网页说明。

发帖数: 8 | 50 今天突然被老板告知funding出了问题 （跟学校会计部门很狗血的一段，略过不提）只
能支持我到二月底，下个月就没钱发我的工资了。
基本情况是学校千老，EB1B 485刚刚交上去，2月的RD，140倒是批了。老板给了两个选
择： 一是转成unpaid contractor, 或者用absence of leave without pay。
现在主要是两个问题：学校基本上不会revoke 140的前提下，哪一种选择对485可能的
RFE更有利一点？如果有什么更好的选择，也望大家不吝指教。因为老板自己感觉不好
意思，所以不是很过分的要求他都有可能帮一下。
咨询了一下办140的律师，也在网上做了一些研究，也没有什么头绪，总的看法是有人
认为H1B 不能without pay，也有人说只要雇主没问题就可以，我也在USCIS 的I9 FAQ
里找到了可以take absence of leave的条款，所以目前还是倾向于用absence of
leave，把保险之类的接着挂在学校上，并争取能让老板写一封intention to hire
