找个精通同权加移民的律师问问吧.有可能移民局不会查的太详细, 必竟你F1的表格上
你还是single吧.当年我和我朋友先一起以partnership申请移民加拿大, 在等待的过程
中又分开各自申请美国移民,美国移民局也没问问题. |

发帖数: 2113 | 5 USCIS查不到結婚記錄。簽證的時候你可以填single，因為移民法屬聯邦法，
DOMA也是聯邦法，高於一切州法。
在州法的定義裡你算是結婚，但同志婚姻在聯邦法的範疇裡不被承認。
當然比較老實的做法就是填已婚，
然後去跟移民官解釋這是怎麼回事。
你的BF I-485 current，不代表你入境就能得到移民的福利。
所以你們的婚姻跟移民的福利沒啥關係。
移民局在行政法規上是可以有一些靈活處理的。
雖然現在移民局對移民法裡頭“marriage” 和“spouse” 的解釋還援引DOMA，
但移民局給同性伴侶一定的政策調整，
比如說B-2簽證可以作為同性伴侶的陪伴簽證。
但是這種陪伴簽證只是給予非移民簽證持有者的伴侶，
相當於F-2，H-4，一類。
跟綠卡持有者或者公民結婚的同志是否可以享有這個福利，
移民局到現在沒有給出如何處理的解釋，
而對於簽證官來說，給不給你簽證或者判定你是否有移民傾向就得碰運氣。
說白了這個事情就是一團糟。
要不就得推翻DOMA，要不就等移民局修改行政意見（這不是不可能，但要看當官的決心有多大）。
複雜事情簡單化的做法就是結婚，但說自己未婚，
如果官方有問題，你就答在聯邦法的定義裡，我確實未婚，誰讓你們不承認呢？！

marriage certificate,未婚的话，又没有个未婚证

Some people use F1 to keep staying here but with gay marriage will your F1
application with USCIS be denied?
