发帖数: 265 | 2 貌似premium的要有该死的I797，因为USCIS两个礼拜就要做决定。我也不是很清楚了，
要是能拿FR申请的话，那我就不用那么担心了。正在郁闷中，照H1b用的这个速度，
10000／month，等我能file premium的时候估计也就剩两三千的名额了。哪位懂的人士
请释疑一下吧。同问。 |

A waiver application on Form I-612 or in conjunction with a temporary worker
petition (Form I-129 ) pursuant to section 214(l) is properly filed at any
of the Service Centers where the applicant is temporarily residing, or, if
the applicant is abroad, at the Service Center located nearest the place
where the applicant last resided in the United States. A waiver request
based on other U.S. government agency sponsorship, State health department
request, or a “no objection” letter may only be filed with the Department
of State’s Waiver Review Division (formerly the USIA). The application is
considered prop erly filed only at such time as the Bureau receives a
favorable recommendation from the Waiver Review Division, normally at the
office where the alien will be seeking adjustment of status. Applications
filed without a Waiver Review Division recommendation should be rejected.
如果我没有理解错的话，意思是说如果I－612和I－129同时file，有DoS的favorable
recommendation的话，那么I－129是properly filed。

另外，我的理解是有了favorable recommendation letter可以确定你不会被拒，但是
并不能保证会approve,有可能是RFE，不知是否对。

发帖数: 81 | 10 infopass的是个老头,看来他也不是很清楚,说如果deny了,你再等;如果接收了,RFE,那
就赢了.这个...等于没说.不过看起来是可以试一试.不过最好还是问律师. |

According to USCIS rules, you can apply for adjustment to H-1B if you have a
concurrently filed J-1 waiver based on no objection with USCIS.
As you probably know, you don't file a no-objection with USCIS. You apply to
the DOS, who then makes a recommendation and forwards that application
along with their recommendation to the USCIS.
What this means is that you CAN apply for H-1B if you have gotten your DOS
recommendation, since the DOS recommendation is a copy of the actual form
they send to USCIS and is evidence that you have a J-1 waiver application
pending at USCIS.
You CANNOT apply for H-1B if the DOS has not yet issued its recommendation,
since that means there is no waiver application pending with USCIS yet.
所以在收到FR以后貌似是可以file H1b的，应该不会被拒的吧？能有RFE就行。。。 |

‘The Department of State recommended me for a waiver in just 2 business
days after they received my documentation. The USCIS approved the waiver a
week after receipt. The attorney submitted an H1-B petition for change of
status (premium processing) as soon as the DOS sent the Favorable
Recommendation to the USCIS. In most cases, to apply for an AOS all you need
is a copy of the favorable recommendation the USCIS will adjudicate both
simultaneously under premium processing. The USCIS took 14 nerve racking
days to process it, but ultimately they approved the petition. ’

Received by DOS: 4/30/2010
Response: Favorable Recommendation 05/04/2010
Received by the USCIS @ VSC: 05/07/2010
Waiver Approved by USCIS: 05/15/2010

Decision: H1-B Approved 05/25/10
Once the Department of State recommends you for a waiver you may apply for
H1B change of status with the recommendation alone. If ur H1B application is
filed for premium processing then the USCIS might adjudicate the waiver
within 15 days as part of the h1b processing.
