如果想在CLOSE前 终止合同,有什么办法吗?
Buyer shall apply promptly for all financing described below and make every
reasonable effort to obtain approval for the financing (Financing Approval).
Buyer shall furnish all information and documents required by lender for
Financing Approval. Financing Approval will be deemed to have been obtained
when (1) the terms of the loan(s) described below are available and (2)
lender determines that Buyer has satisfied all of lender's financial
requirements (those items relating to Buyer's assets, income and credit
history). If Buyer cannot obtain Financing Approval, Buyer may give written
notice to Seller within 15 days after the effective date of this contract
and this contract will terminate and the earnest money will be refunded to
Buyer. If Buyer does not give
such notice within the time required, this contract will no longer be
subject to Financing
Approval. Time is of the essence for this paragraph and strict compliance
with the time
for performance is required.
NOTE: Financing Approval does not include approval of lender's underwriting
requirements for
the Property, as specified in Paragraph 4.A.(1) of the contract.

就是说你如果在attorney review结束以后15天申请不到loan, 在这中间需要让卖方知道,
否则你就必须买,如果你无论如何申请不到loan,你的earnest money就没有了。
这肯定是对方律师写的,这样太扯了,一般来说15天之内commit太赶了。你说需要21天
申请loan,如果21天之内不能拿到银行的commitment,either party shall make time
of the essence with respect to the loan contingency by giving seven days
written notice to the other party within which time said other party must
respond regarding same. If such party does not respond, the party making
time of the essence shall have the right to terminate the contract or deem
the contingency waived.
这样你基本上能够争取到至少一个月的时间申请loan。。。

另外问一下, 我签合同大概是5月18, CLOSE 是 6月29.
现在后悔来的及吗? 是不是只要放弃 EARNEST MONEY 就可以了? |

是这样就可以了,seller不会去告你的 。。。

现在想退出由于一些意外的原因.
LOAN 批准了, 我可以让银行收回LOAN. 这样是不是只能放弃 4000$ EARNEST FEE. 然
后SELLER 会不会不同意而告我啊.
好象SELLER 着急等我们的前去买新的房子. |

正常的合同情况下一般都会写上说双方都可以诉求由对方违约造成的一切损失,
而不是放弃earnest money了事。
如果seller存心要和你为难,他们有权利要求你提供loan application的信息。
很多seller拿到earnest money算了就是了。
