今年申办H1B。如果同时某发了offer的B公司也帮我办H1B并且A和B两家的H1B在未来的
四五月份都approve的话，我OPT的gap cap extension申请应该使用哪个H1B呀，假设提
交gap cap extension时已在B公司上班？如果七月初之前去了B公司上班的话，我要如
何操作才能算作我接受并使用了B公司的H1B，以及A公司的H1B需要做如何处理，还是无
需处理？

“Multiple or Duplicative Filings
On March 19, 2008, USCIS announced a regulatory change to prohibit employers
from filing multiple or duplicative H-1B petitions for the same employee.
To ensure fair and orderly distribution of available H-1Bs, USCIS will deny
or revoke multiple or duplicative petitions filed by an employer for the
same H-1B worker and will not refund the filing fees submitted with multiple
or duplicative petitions.”

“Not true. Their policy states that a single employer cannot file multiple
petitions for the same employee. Different employers can file petitions for

我的理解是USCIS不接受multiple or duplicative petitions filed by an employer
for the same H-1B worker，但可以接受multiple or duplicative petitions filed
by different employers for the same H-1B worker

gap cap extension is automatic once your H1 is pending (if OPT expires), no
need of USCIS approval. You can show your university with H1 receipt from
the company you decide to go with, if you want to get I-20 printed with gap
cap extension. |
