担心出什么问题），后来告诉律师（美国律师）说曾经是党员，律师说必须来美国满5
年（也就是说5年没有交党费，自动退党）才能递交485 （说是法律的规定）。还说最
好到国内找到最后一次交党费的证据。我把网上大家用的statement给她看了，她说也
比较满5年才行。
请有经验的人具体说说吧，心理着急的很。谢谢！ | b*********r

发帖数: 1322 | 7 你的律师说的是对的。党员的485一般不能批准，除非满足三条豁免条件之一。其中一
个豁免条件就是过去的两年内都不是党员，但是如果这个国家还在这个党的专政统治下
，这个条件是5年。
但是还有另外一个豁免条件，就是你当初入党是出于非自愿，出于获取食物/雇佣关系
等生活必须资料所必须。
实际操作中，只要附了statement, 没听说过谁出问题的。5年不5年关系不大. IO也不
一定细读法律细到了这个地步。
具体法律见下面。注意好好读读Exception的前两条。第三条跟你们没关系。

the Communist or any other totalitarian party.
DETAILS: Alien is inadmissible (under this ground):
regardless whether the party is or was domestic or foreign, and

EXCEPTIONS:
1. Under INA 212(a)(3)(D)(ii) – If the membership or affiliation is or was:
involuntary,
solely when alien was under 16 years of age,

for purposes of obtaining employment, food rations, or other essentials

2. Under INA 212(a)(3)(D)(iii) – If:
(I) the membership or affiliation terminated at least:
2 years before the date of the application, or

affiliation was with the party controlling the government of a
foreign state that is a totalitarian dictatorship as of such date, and
(II) the alien is not a threat to the security of the U.S.
3. Under INA 212(a)(3)(D)(iv) – If the alien is:
the parent, spouse, son, daughter, brother, or sister of a U.S. citizen
or
a spouse, son, or daughter of a permanent resident.
The Exception 3 may apply only:
at INS discretion,
if the immigrant is not a threat to the security of the U.S.
AND
for humanitarian purposes, to assure family unity, or
when it is otherwise in the public interest.
