我的感觉是，这是新总统和司法部长 re-enforce law and order的精神的传递
这个INA 要求每个季度配额27%
我们来看EB2 2013.7.1以前目前用掉27% 2013.07.01到2013。12.15 根据奥本说估计还
剩个800-1000人
如果他第二个季度就放水显然就违反INA这个法律
所以我个人还是认为EB2放水发生在财年第三季度

回来的时候边境以他精神有毛病为由想拒绝他入境，上诉到最高法院，最高法院没有谈

INA 202
要抗争我支持，但是绝对不能做莽夫，我们都是有硕士以上学历的，不能像美国底层的
黑人一样只拿歧视做口号，好歹人家是有投票权的，说出来的话议员更重视。
如果要抗争，我想有3个原则
1）一个声音说话，不要拿骚扰当策略。无论是我们内部选代表还是雇专业的，都要做
有尖锐性的抗争。
2）不要重复投资，捐的钱都是大家养家钱里扣的，已经做过的研究要充分Share。
3）弄清楚我们的矛头到底是什么？？？？
a. 是不是DOS？
DOS拿INA 202做依据，而且堂而皇之用了9年了，那么唯一可以攻击的地方就是INA 202
本身。
INA 202到底是法律还是移民局的操作指导？
如果是操作指导，必须找出它和现行法律相抵触。
如果是法律，只能告ＤＯＳ用错法律了。
如果找不到理由告他用错了，就不可能告他歧视，毕竟INA 202没有写“中国”必须少
拿名额
如果没有用错法律，那么在EB2I的排期和EB2C一致前，他有理由把全部的名额给印度。

非PR外国人没区别，也就是在境外的PR并没有宪法层面的liberty interest。当然没有
这方面的判例，主要是因为之前从来没有总统想到过大规模剥夺境外PR的入境权，这个
真打到最高法院也许会产生新的宪法层面的判例，这不好说。但是在宪法层面之下，既
然是INA给的，INA can take it away。INA 1182(f)并不区分有无绿卡的外国人，所以
1182(f)就是take it away的一种方式，而1182(f)并不要求任何due process。 |
