due to abandonment must be filed with evidence that the decision was
in ERROR because:
(i) The requested evidence was not material to the issue of eligibility;
(ii) The required initial evidence was submitted with the application
or petition, or the request for initial evidence or additional
information or appearance was complied with during the allotted
period; or
(iii) The request for additional information or appearance was sent to
an address other than that on the application, petition, or notice of
representation, or that the applicant or petitioner advised the
Service, in writing, of a change of address or change of
representation subsequent to filing and before the Service's request
was sent, and the request did not go to the new address.

放弃而否决你的申请是错误的.比如1，他们要求的材料对于你的申请不重要，2，他们
要求的材料你在最初就递了或者在要求的时间内递了，3，他们的rfe送到了错误的地址
，或者在他们的要求发出前，申请人已经书面提出更改地址的要求，而移民局没有把要
求送到新地址。
看起来像是移民局送了rfe你没有回复所以被拒了。 | r*******y

1. I submitted the RFE package on the 87th day, which I have the certified
mail receipt, but I am not sure that they require to submit (that is what
the RFE states) or receive the package within 87 days.
2. I changed my address, I sweared to God that I filed the R11(online
address change), but I can not find the confirmation email since they DO
send the RFE letter to my old address after I changed my address.

request before RFE. :)

发帖数: 2495 | 6 You can say due to their error (by sending the RFE to the wrong address),
you did not receive the RFE on time, thus you could not submit the requested
information on time.
